CHAPTER 255
(Senate Bill 696)

AN ACT to add new Section 249 (j) to Article 56 of the Annotated
Code of Maryland (1968 Replacement Volume), title "Licenses,"
subtitle "Home-Improvement Law," to follow immediately after
Section 249 (i) thereof; and to repeal and re-enact, with amend-
ments, Sections 250 (b), 250 (c), 252 (a), 252 (d), 252 (f), 253
(e), 259 (a), 259 (b), 260 (a), 260 (b) and 260 (c) of Article 56
of said Code (1968 Replacement Volume and 1970 Supplement),
title "Licenses," subtitle "Home-Improvement Law," defining the
term "Commissioners"; providing that the terms "Commissioner"
and "Commissioners" be used in place of various other terms;
providing that the executive director of the Commission shall be
subject to removal by the Secretary of Licensing and Regulation
and not by the Commission; providing that TO WHOM the execu-
tive director shall be responsible; only to the Secretary of Licen-
sing and Regulation;
and generally relating to the Maryland
Home-Improvement Commission.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 249 (j) be and it is hereby added to Article 56
of the Annotated Code of Maryland (1968 Replacement Volume),
title "Licenses," subtitle "Home-Improvement Law," to follow imme-
diately after Section 249 (i) thereof; and that Sections 250 (b),
250 (c), 252 (a), 252 (d), 252 (f), 253 (e), 259 (a), 259 (b), 260
(a), 260 (b) and 260 (c) of Article 56 of said Code (1968 Replace-
ment Volume and 1970 Supplement), title "Licenses," subtitle "Home-
Improvement Law," be and they are hereby repealed and re-enacted,
with amendments, and all to read as follows:

(j) "Commissioners" shall mean the members of the Commission
who have been appointed by the Governor.

250.

(b)   Each [member of the Commission] Commissioner shall be
appointed by the Governor, with the advice of the Secretary of
Licensing and Regulation, for a term of four years, except that
when a vacancy occurs before the expiration of a term, the Gov-
ernor, with the advice of the Secretary of Licensing and Regula-
tion, shall appoint the successor to serve for the remainder of the
term. One of the [members] Commissioners shall be designated
chairman by the Governor, with the advice of the Secretary of
Licensing and Regulation.

(c)   The Governor, with the advice of the Secretary of Licensing
and Regulation, shall appoint as [members of the Commission]
Commissioners, no less than two persons who are qualified by ex-
perience in at least some phase of the home-improvement industry,
and no less than one person who is qualified by experience in the
business of banking or finance. Each [member] Commissioner shall
have been a citizen and resident of this State for not less than five
years preceding his appointment.
