provide for the transfer of all appropriations, credits, liabilities,
and, obligations of the Judicial Council to the Board of Public
Works.
Whereas, Sections 102 to 106, inclusive, of Article 26, concerns
the creation and operation of a Judicial Council to continuously study
the organization, operation, rules and methods of procedure and
practice of the judicial system of the State of Maryland; and
Whereas, The Judicial Council, created in 1924, has not operated
for many years; and
Whereas, The Burke Commission in 1953 reported that the law-
establishing the Judicial Council was then defunct and had been for
many years; and
Whereas, The Maryland Judicial Conference and the Court of
Appeals of Maryland Standing Committee on Rules of Practice and
Procedure have taken over the functions of the Judicial Council;
therefore
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 102 to 106, inclusive, of Article 26 of the Annotated
Code of Maryland (1966 Replacement Volume), title "Courts," sub-
title "Judicial Council," be and they are hereby repealed as follows:
[102.
There shall be a "Judicial Council," consisting of nine members,
for the continuous study of the organization, operation, rules and
methods of procedure and practice of the judicial system of the State
of Maryland; the work accomplished and the results produced by
that system and its various parts. The terms of office of the members
of the Council first appointed shall be three years, and until their
successors shall be appointed and qualified, and thereafter the terms
of office shall be two years and until the appointment and quali-
fication of their successors. All the members shall be appointed by
the Governor, but he shall appoint as the president of the Council,
the Chief Judge of the Court of Appeals of Maryland, and he shall
also appoint as a member of said Council, the Chief Judge of the
Supreme Bench of Baltimore City. There shall also be appointed
as a member of said Council, an Associate Judge of the Court of
Appeals, recommended by the Judges thereof, and an Associate Judge
of the Supreme Bench of Baltimore City, recommended by the Judges
thereof. There shall also be appointed as a member of said Council,
an associate circuit judge from the Eastern Shore of Maryland,
selected by the Governor from among those recommended by the
judges of each of said circuits, and an associate judge from the
Western Shore of Maryland, outside of Baltimore City, selected from
among those recommended by the judges of each of said circuits,
and three lawyers engaged in the active practice of law; one of whom
shall reside in, and have a law office in the City of Baltimore; one
of whom shall reside in and have a low [law] office in some one of
the counties of the Western Shore of Maryland, outside of the City
of Baltimore; and one of whom shall reside in, and have a law office
in some one of the counties of the Eastern Shore of Maryland.
