CHAPTER 497
(House Bill 31)

AN ACT to repeal and re-enact, with amendments, Section 4 of
Article 78D of the Annotated Code of Maryland (1969 Replace-
ment Volume), title "Regional Planning Council," subtitle "Estab-
lishment and Organization," to re-designate certain members of the
Regional Planning Council, and to specify who shall be ex-officio
members, AND TO SPECIFY THAT EX OFFICIO MEMBERS
AND THEIR ALTERNATES SHALL NOT HAVE VOTING
RIGHTS AND POWERS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 4 of Article 78D of the Annotated Code of Maryland
(1969 Replacement Volume), title "Regional Planning Council," sub-
title "Establishment and Organization," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

4.

(a)    Enumeration of members.—The membership of the Council
shall include THREE representatives from the City of Baltimore,
three representatives from each of the counties of Anne Arundel,
Baltimore, Carroll, Harford and Howard, [the Director of the State
Department of Planning, the Chairman-Director of the State Roads
Commission, the chairman of the Metropolitan Transit Authority,
the chairman of the Maryland Port Authority] the Secretary of the
Maryland Department of State Planning the Secretary of the Mary-
land Department of Transportation, the Secretary of the Maryland
Department of Natural Resources, the
Secretary of the Maryland
Department of
Health and Mental Hygiene
THE SECRETARY OF
STATE PLANNING, THE SECRETARY OF TRANSPORTATION,
THE SECRETARY OF NATURAL RESOURCES, THE SECRE-
TARY OF HEALTH AND MENTAL HYGIENE and four repre-
sentatives to be appointed by the Governor, namely, a member of
the Maryland Senate, a member of the Maryland House of Delegates,
and two citizens of the State of Maryland, as follows:

(b)    Members from Baltimore City.—The mayor of the City of
Baltimore shall be a member of The Council and he shall have au-
thority to nominate, constitute and appoint a permanent alternate,
who shall be an elected or appointed official of the City of Baltimore
to serve, in his absence as a member of The Council. THE PRESI-
IDENT OF THE CITY COUNCIL OF THE CITY OF BALTI-
MORE SHALL BE A MEMBER OF THE COUNCIL AND SHALL
HAVE AUTHORITY TO NOMINATE, CONSTITUTE AND
APPOINT A MEMBER OF THE CITY COUNCIL TO SERVE,
IN HIS ABSENCE AS A MEMBER OF THE COUNCIL. The
mayor of the City of Baltimore shall appoint a member of the Balti-
more City planning commission as a member of The Council.

(c)    Members from Anne Arundel County.—The county executive
of Anne Arundel County shall be a member of The Council and shall
have authority to nominate, constitute and appoint a permanent
alternate, who shall be an elected or appointed official of the govern-
ment of Anne Arundel County, to serve in his absence as a member
of The Council. The chairman of the County Council of Anne Arundel
