(7) "Division" means such organizational subdivision of the
State Police as is designated by the Superintendent of State Police
to administer the provisions of this subtitle.

§ 13-102. Licensing of inspection facilities.

(a)    There is created within the State Police an Automotive
Safety Enforcement Division. It shall have such number of em-
ployees as the superintendent may direct and as may be provided for
in the annual state budget.

(b)    The division shall inspect and approve registered dealers and
approved facilities for ability to make inspections and corrections of
equipment and mechanisms and shall issue licenses to qualified regis-
tered dealers and approved facilities. The license shall authorize the
registered dealer or approved facility to attach certificates to vehicles
upon the request of the seller of a used motor vehicle and to inspect
and correct equipment and mechanisms for a vehicle for which a
warning of defective equipment and mechanisms has been issued.
The division is authorized to suspend or revoke for cause licenses
issued to approved dealers or approved facilities and, to require the
surrender of a license and all pertinent paraphernalia upon suspen-
sion or revocation of a license.

(c)    The division shall enforce the provisions of this subtitle in
the counties of the State and in Baltimore City.

§ 13-103. Equipment required to meet standards fixed by depart-
ment.

Every motor vehicle operated on the highways of the State shall
be equipped with brakes, steering, horn, door handles, tires, exhaust
system, lights, glass, windshield wipers, odometer, speedometer,
bumpers and proper wheel alignment, wheels, wheel lugs, fenders,
floor pans, hood and hood catches, and gas tank meeting the stand-
ards therefor as fixed and determined by the department. The de-
partment is authorized to promulgate the standards by means of
rules and regulations.

§ 13-104. Warning for defective equipment and mechanisms.

(a) Whenever any member of the State Police or any officer of a
county department, or any officer of a police department of a city
with a population in excess of 5,000 persons, observes that a motor
vehicle registered in Maryland is being operated with equipment and
mechanisms which apparently do not meet the standards therefor as
promulgated by the department, he shall stop the operator of the
vehicle and issue to him a warning of defective equipment and
mechanisms. The warning directs the owner of the vehicle to have
the equipment and mechanisms which are indicated on the warning
as apparently defective corrected at a place of the owner's choosing
within a period of 10 days from the date of issuance of the warning
and to forward to the division verification by an approved facility,
signed and dated as required for a certificate, that on a date subse-
quent to the issuance of the warning the equipment and mechanisms
so indicated comply with the standards prescribed by this subtitle.
