CHAPTER 753
(House Bill 86)

AN ACT to add new Section 715 (d) to Article 66C of the Annotated
Code of Maryland (1957 Edition and 1960 Supplement), title "Nat-
ural Resources", sub-title "Oysters and Clams", adding certain
provisions to the laws concerning the taking or catching of soft
shell clams in Anne Arundel County in order to clarify a possible
uncertainty in those laws.

Whereas, Chapter 828 of the Acts of 1959 repealed Section 715 (d)
of Article 66C of the Code concerning the taking or catching of soft
shell clams in Anne Arundel County, and

Whereas, It was not the legislative intention to repeal this sec-
tion as demonstrated by the fact that portions of this section had
already been amended in Chapters 691 and 692 of the Acts of 1959,
and

Whereas, to avoid any uncertainty as to the present terms of the
laws concerning the taking and catching of soft shell clams in Anne
Arundel County, it is desirable to re-enact this section and also to
incorporate therein the changes made by Chapters 691 and 692 of
the Acts of 1959, now, therefore

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 715 (d) be and it is hereby added to Article 66C of
the Annotated Code of Maryland (1957 Edition and 1960 Supple-
ment), title "Natural Resources", sub-title "Oysters and Clams", to
read as follows:

715.

(d) SameRegulations.In Anne Arundel County it shall be un-
lawful to take or catch soft shell clams by use of hydraulic, mechanical
or other dredge:

1.   On Sunday, or between sunset and one-half hour after sunrise
on any other day, or to land soft shell clams before sunrise or later
than one (1) hour after sunset;

2.  Within 300 100 feet of any commercially productive oyster tong-
ing area defined on the charts of the Commission of Tidewater Fish-
eries, or as defined under Section 696 (i) of this article, or as marked
with stakes as may be required by the Commission of Tidewater
Fisheries;

3. Within 500 yards of any duly licensed OCCUPIED blind during
the open season for duck or goose hunting in Maryland;

4. During the period from April 15th through September 15th
of each year within 500 in front of any sea nettle net and for any
public bathing beach at any time
AND WITHIN 800 FEET OF
