may prescribe, provided that the other state accords similar privi-
leges to persons originally licensed by this State, and provided also
that the standards for licensing in the other state are not lower than
those in this State.

357. Duties and profession of embalmer.

The duties of an embalmer and the profession of embalming as
referred to in this subtitle are defined as the thorough disinfection
of human bodies or any part thereof by arterial and cavity injection.

358. Apprentices.

Before any person serves as an apprentice of a licensed funeral
director and embalmer he shall register with the Board as an appren-
tice. The registration shall be made in such manner as the Board
may direct. A registration shall be renewed on application annually
on or before the first day of May in each year so long as the licensed
apprentice continues to serve as such. The applicant shall pay to the
Board a fee of $10 for the original registration as an apprentice
and for each renewal registration.

359. Penalties.

(a) Any person who practices as or holds himself out for prac-
ticing the occupation of funeral director and embalmer in this State
without having secured a license for such practice and without
holding a current license is guilty of a misdemeanor and upon convic-
tion thereof is subject to a fine of not more than $100 or imprison-
ment for not more than one year, or both such fine and imprisonment,
in the discretion of the Court. Nothing in this sub-section applies to
a registered apprentice of a licensed funeral director and embalmer
during the period of his apprenticeship. Nothing in this subsection
applies to any school of anatomy, medicine or dentistry. Nothing
in this subsection shall be deemed to apply or interfere with any
officer or employee of the United States or the District of Columbia
in the discharge of his official duties.

(b) Any violation of the provisions of this subtitle other than those
in subsection (a) hereof is a misdemeanor and subject upon con-
viction to a fine of not more than $100 or to imprisonment for not
more than one year, or to both such fine and imprisonment, in the dis-
cretion of the Court.

360. Rules and Regulations of the Board.

The Board of Funeral Directors and Embalmers may adopt and
promulgate such rules and regulations for the enforcement of the
provisions of this sub-title and for the performance of their duties
under this subtitle as in their judgment from time to time they deem
necessary. The Board is authorized to investigate any alleged viola-
tions of the provisions of this subtitle, to swear out warrants against
an alleged violator thereof, to aid in the prosecution of an alleged
violation and in general to enforce and make effective the provisions
of this subtitle. Any and all expenses, costs and fees incurred by the
Board in enforcing the provisions of this subtitle shall be paid out of
the monies received by the Board under this subtitle.
