Section 1. Be it enacted by the General Assembly of Maryland,
That Section 49 of Article 2B of the Annotated Code of Maryland
(1957 Edition), title "Alcoholic Beverages", sub-title "General Pro-
visions on Issue of Licenses", be and the same is hereby repealed
and new Section 49 enacted in lieu thereof, to stand in the place
and stead of the section so repealed and to read as follows:

49. (a) In Charles County, when application for a liquor license
is made to sell alcoholic beverages in a building which is not com-
pleted, the Charles County Liquor Board and County Commissioners
may give tentative approval of the application on the basis of plans
and specifications accompanying the application. Upon completion
of the building in accordance with the aforesaid plans and specifica-
tions, the liquor board may give final approval of the application.
Any new license approved by the board after June 1, 1953, shall
not be issued unless confirmed by the County Commissioners of
Charles County.

(b)  In Charles County, the liquor board shall not approve any
license to sell alcoholic beverages in any building the nearest wall
of which measured in a direct line is within five hundred (500) feet
of the property line of any school, church or other place of worship,
PROVIDED, HOWEVER, THAT THIS SUB-SECTION SHALL
NOT BE APPLICABLE IN THE EVENT ANY SCHOOL,
CHURCH, OR OTHER PLACE OF WORSHIP LOCATES ITS
BUILDING WITHIN 500 FEET OF ANY LICENSED PREMISES
AFTER THE LICENSED PREMISES ARE THERE ESTAB-
LISHED.

(c)  Nothing in this section shall apply to or affect or prohibit, in
any manner, the renewal or transfer of any license issued prior to
June 1, 1959.

SEC. 2. AND BE IT FURTHER ENACTED, THAT NOTWITH-
STANDING ANYTHING TO THE CONTRARY HEREINABOVE
IN THIS ACT, THE PROVISIONS OF SUB-SECTIONS (A) AND
(B) OF THIS ACT SHALL NOT APPLY IN THE EVENT THE
APPLICANT AFFIRMATIVELY SHOWS THAT HE BEGAN
CONSTRUCTION OF A NEW BUILDING FOR THE PURPOSE
OF SELLING ALCOHOLIC BEVERAGES THEREIN ON SOME
DATE NOT LATER THAN APRIL 1, 1959.

Sec. 2 3. And be it further enacted, That this Act shall take effect
June 1, 1959.
