thereafter, and shall be kept up and repaired as all other public
wharfs in said county are; Provided, that nothing herein con-
tained shall in any manner authorise the said commissioners to lay
out the said wharf and lumber yard through the buildings, garden,
orchard or yard, of any person or persons, without his, her,
or their consent.
4. And be it enacted, That the persons interested in laying out
the said wharf and lumber yard, shall pay to the commissioners
the reasonable expenses for surveying and laying out the said
ground for a public wharf and lumber yard, and making out and
returning the said plot.

CHAPTER 258.

An act for the benefit of Lawson Alexander, and the Re-
presentatives of the late Reverend Joseph Cowden.
Sec. 1. Be it enacted by the General Assembly of Maryland,
That the judges of Cecil county, or any two of them, be and
are hereby authorised and empowered, to appoint three disinte-
rested persons of sound judgment, as commissioners, to value
that part of a tract or parcel of land called Catto's Range, which
was sold to the Reverend Joseph Cowden, late of said county,
deceased, as confiscated property, by the commissioners of this
state, when in fact the same was the right and estate of Lawson
Alexander.
2. And be it enacted, That the said commissioners so to he ap-
pointed as aforesaid, shall, alter taking an oath before some
justice of the peace of said county, (or affirmation as the case,
may be) truly and fairly to value the same, proceed to examine
the said parcel of land so as aforesaid sold, and upon such ex-
amination make a return of the value thereof to the said court,
under their hands and seals.
3. And be it enacted, That if upon the return of said valuation,
so to be made as aforesaid, the said Lawson Alexander shall, by
a good and sufficient deed, release all his right and title to the
said parcel of land to the said representatives of the said Joseph
Cowden, or their assigns, that then and in that case the said
judges, or any two of them, shall be and are hereby authorised
and empowered, to draw on the treasurer of the western shore in
favour of the said Lawson Alexander, for the amount thus esti-
mated as the value of the said land, together with the costs in-
curred by the plaintiff and defendant in the prosecution of the
suit now depending in Cecil county court, and the said treasu-
rer is hereby authorised and required, upon the presentment of
said draft, to pay the amount thereof to the said Lawson Alex-
ander, or his order, he securing to the representatives of said
Joseph Cowden their proportion of said cost of suit..

CHAPTER 259.

An act for the encouragement of Literature.

Sec. 1. Be it enacted by the General Assembly of Maryland,
That for the increase of the school fund of this state, there shall
be raised by lottery the sum of fifty thousand dollars a year, for
five successive years, if practicable.
