of the western shore for the above mentioned proportion of their
respective county, that the treasurer shall be authorised and re-
quired to dispose of such part of the fund appropriated for the
establishment of free schools throughout the state, as is requi-
site to pay off the respective proportion of the county from
which such application is made.
5. And be it enacted, That it shall be the duty of the com-
missioners of the school fund of each respective county annually
to report to the general assembly the manner in which their pro-
portion of the school fund may have been disposed of.
6. And be it enacted, That no commissioner of the school fund
appointed by this act, shall receive any compensation for the per-
formance of the duties required of him by the said act.
7. And be it enacted, That the treasurer of the western shore
be and he is hereby directed, to pay to the order of the levy
courts of Frederick, Washington, and Allegany counties, their
county proportion respectively of the school fund aforesaid, to
be invested under the direction, and in the name of the levy
court of the county, in such manner as may be most likely per-
manently to secure the means of education as contemplated by
the act providing said school fund, until the principal and inte-
rest may be sufficient, in the opinion of the levy court of the
county, to provide and establish a central free school in each
election district of said county, any thing in this act to the con-
trary notwithstanding.

CHAPTER 257.

An act to lay out ground for a Wharf and Lumber Yard
at Mattapony Landing, in Worcester County.
Whereas, it is represented to this general assembly, by the
petition of sundry inhabitants of Worcester county, that they
labour under great inconvenience for want of a public wharf and
lumber yard at Mattapony landing; Therefore,
Sec. 1. Be it enacted by the General Assembly of Maryland,
That John Holland, James Bevans, Robert II. Johnson, Littleton
D. Bevans and Giles Jones, senior, be and they are hereby ap-
pointed commissioners to lay out, survey, mark and bound, a piece
of ground for a public wharf and lumber yard, at Mattapony
landing, in Worcester county, not exceeding two acres, in suck
form as the nature of the ground and the. convenience of the
landholders over which the same may run will admit.
2. And be it enacted. That the said commissioners, or a ma-
jority of them, shall ascertain the damages which any person or
persons may sustain by reason of the said wharf and lumber
yard being laid out from his, her, or their lands, which shall be
first paid, or secured to he paid, by the persons interested in
laying out said wharf and lumber yard, before the said wharf
and lumber yard be made public.
3. And be it enacted, That the said commissioners, or a ma-
jority of them, are hereby directed to return a plot of the said
wharf and lumber yard, when surveyed, marked and laid out
as aforesaid, to the clerk of the county court, to he by him re-
corded; which wharf and lumber yard, when laid out, shall be
deemed and taken as a public wharf and lumber yard for ever
