68                                  June Court 1729

Same Elizabeth To the high displeasure of almighty God to y.e Evil Example
of the Others in Such case offen^d^ing contrary to the peace of
the Said Lord prop.ry his Good rule & Government and against
the form of the Act of Assembly in Such case made wherefore the
afd attorney ^prayeth^ the advice of the Court herein the premisses for y.e s.d
Lord prop.ry & due process of Law ag.ts y.e afd Francis in this part to
issue to Answer to y.e s.d Lord prop.ry of & upon the Premisses &c.a

    And the afd ffrancis Pool comes and Saith that he Cannot gainsay the Indictm.t
afd so as afd brought nor but that he is guilty of the premises upon him Imposed as
it is by the afd Indictment alledged  And Thereupon Submits to the Court Therefore
it is Considered  by the Court here viz.t At the Court House in the Town of Chester
in Said County on the Third tuesday in June being the Seventeenth day of said
Month Anno Dom. seventeen hundred and twenty Nine That the Said Francis
Pool pay the Sume of twelve hundred pounds of Tobacco Debt According to Act
of Assembly in Such case lately made and provided for his Offence for Committing
adultery as afd And also pay the Sume of five hundred and three pounds
of Tobacco Costs Accruing on his premises afd to the officers of this Court

    Ordered by the Court here that Joseph Young Gent high Sherf of Said County keep
the afd Francis Pool in Safe Custody untill his fine of twelve hundred pounds of
Tobacco and the Costs afd Shall be paid

    Ordered by the Court here the Sherf Should keep the afd Francis in Custody
for his appearance during the Courts Setting  Thereupon the Said Francis
Pool in his proper person acknowledged himselfe Indebted to the Right Hon.ble
the Lord prop.ry his heirs & Successors in the Sum of tenn pounds Sterling to
be Leveyd on his goods and Chattles Lands and Tenements Conditionally that if
he Shall not Appear at any time during the Courts Setting to answer unto
what Should be objected against him on his Ldshps behalfe and to be of good
behaviour wherewith he Acknowledges himselfe Content

    Likewise came into Court Arthur Foreman & Doannok Kenslaugh and
acknowledged themselves indebted to the Right Hon.ble the said Lord proprietarie
his heirs and Successors in the Sume of five pounds Sterl Each to be
Leveyed on their goods and Chattles Lands and Tenements Conditionally that if
the Said Francis Pool Shall not appear at any time during these Court Setting
to answer unto what Shall be objected against him on his Lordships behalfe and to
be of good behaviour &c.a wherewith they acknowledge themselves to be Content

    After which came againe into Court the Said Francis Pool in his proper person
Ordered by the Court here that his said Recogniz.c and his Suretys might be disch.d
The said Francis Pools Recognizance and his Suretys are by this Court
here Disch.d &c.a
