To the Clerk of the Court of Appeals:

I, BERTRAM L. BOONE II, SECRETARY OF STATE OF THE STATE
OF MARYLAND, pursuant to the direction contained in Section
194 of Article 33 of the Annotated Code of Maryland as
amended by Chapter 934 of the Acts of 1945, DO HEREBY
CERTIFY, That Chapter 1034 of the Acts of the General As-
sembly of Maryland of 1945, provided for the submission of
said Act to the voters of the Town of Capitol Heights for
their adoption or rejection under the provisions of the Con-
stitution of the State, said Act being:

"An Act to define the boundaries of Capitol Heights, pro-
viding for its government by a Mayor and Common
Council; and to define the rights, powers and duties
of said Mayor and Council".

AND i DO CERTIFY, That said election was not held in the
town of Capitol Heights as provided by Chapter 1034 of the
Acts of the General Assembly of Maryland of 1945.
