CHAPTER 649.
AN ACT to reimburse Walter Clark, of Annapolis, a sum of
money expended by him upon ten acres of leased oyster bot-
tom in Carr's Creek, Anne Arundel county, ceded to the
United States by the State of Maryland.
WHEREAS, The Board of Shell Fish Commissioners of Maryland
on the second day of September, 1909, leased unto Walter
Clark, of Annapolis, for the term of twenty years, a parcel
of the bottom of Carr's creek, in Anne Arundel county,
described in a lease of that date as containing ten acres, for
bedding and planting oysters under an act of the General
Assembly.
WHEREAS, The said Walter Clark took up the said leased prop-
erty and planted the same during the seasons of 1909 and
1910 with oysters and paid unto the State of Maryland
various sums of money as rent and the costs of said lease
and the survey of the same; and,
WHEREAS, By an Act of the General Assembly of Maryland,
Chapter 394, Acts of 1910, the State ceded the jurisdiction
of the State of Maryland to the United States of America
over all the lands lying under the waters of Carr's creek in
Anne Arundel county, bordering on and adjoining the prop-
erty of the United States, and under such authority the
United States took possession of said property, including
the ten acres previously leased unto the said Walter Clark,
and thereby prevented him from realizing upon any benefit
for the large sums of money paid by him under said lease
and in planting oysters, to his great loss and injury.
SECTION 1. Be it enacted by the General Assembly of Mary-
land. That the Comptroller of the Treasury be and he is hereby
authorized and directed to issue his warrant upon the Treasurer
of Maryland in favor of the said Walter Clark for the sum of
five hundred dollars to reimburse him for all sums of money
paid unto the State of Maryland, or otherwise, and for all loss
incurred by him by reason of the cession of his leased property
to the United States Government.
SEC. 2. . And be it further enacted, That this act shall take
effect from the date of its passage.
