Repealed and
re-enacted.
|
SEC. 3. And be it enacted, That section thirteen of
the act of eighteen hundred and sixty-seven, chapter
three hundred and three, entitled "An act to revive
and extend an act to incorporate the Worcester Rail-
road Company, " passed at the January session, eigh-
teen hundred and fifty-three, with amendments, be
and the same is hereby repealed and re-enacted to
read as follows:

May purchase

That the said president and directors, or a majority
of them, may purchase with tin; funds of the said
company, and place on said railroad, all machines,
wagons, engines, vehicles or carriages whatsoever,
for the purpose of transportation on said road; and
shall not charge for transposition a higher rate of
toll per mile, for any distance over ten miles, than

the following, namely: on goods, produce, merchan-
dise or property of any description, than ten cents a
ton; on lumber, bark or staves, by the car load, five
cents per ton; on cord wood, by the car load, five
cents per cord; on shingles, by the car load, four
cents per thousand. Provided, the said company
may charge for the transportation of any single

package, for any distance, twenty-five cents; and for
the transportation of any passenger, shall not charge
for any distance over ten miles a higher rate than six
cents per mile, including baggage to the extent of
fifty pounds, or occupying a space not exceeding
four cubic feet; and it shall not be lawful for any
person or persons to travel upon or use said road, or
to transport persons, merchandise, produce or other
property along said road, without the license of said
president and directors, or a majority of them; and
the said road, with its works, improvements and
profits, and all the machinery of transportation used
on said road, are hereby vested in said Worcester
Railroad Company, thus incorporated, and their suc-
cessors forever, and the shares of the capital stock
of said company shall be deemed personal estate.

SEC. 4. And be it enacted, That, this act shall take
effect from the date of its passage..
