BALTIMORE COUNTY.

 

AN additional SUPPLEMENT to the ACT, entitled, an Act for the despatch
of Business in Baltimore County Court.— 1837, ch. 72.

Proviso
repealed.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That the proviso to the fourth section of the act of assembly,
passed at December session, eighteen hundred and thirty-four,
chapter two hundred and eleven, be and the same is hereby
repealed.

SEC. 2. And be it enacted, That if at the end of any quar-
ter year, or at the end of any year, or at any other time, there
shall remain or be in the hands of the clerk of Baltimore
county court, after he shall have paid over to the treasurer of
the western shore an amount equal to the additional compensa-
tion authorized by the act of December session, eighteen hun-
dred and twenty-eight, chapter one hundred and twenty-seven,
entitled, an act for the compensation of the judges of Baltimore
county court, any surplus, or excess or excesses of moneys
received by him under the provisions of the act passed at De-
cember session, eighteen hundred and twenty-eight, chapter one
hundred and sixty-one, to which this is a supplement, or under
any provision of any of the supplements to said original act, or

of any other act making provision for the compensation of the
judges aforesaid, then the said judges shall be entitled to any
such surplus, or excess or excesses, to be equally divided
among them at the end of each quarter year, or year, or at any
time when such excess or excesses shall accrue, and it shall be
the duty of the clerk of Baltimore county court, and he is
hereby directed and required to divide any such surplus, excess
or excesses, whenever the same shall accrue, equally among

tinue in force until the first day of January, eighteen hundred
and forty, and until the end of the next session of the general

SEC. 1 . Be it enacted, by the General Assembly of Maryland,
That Baltimore county court shall be, and they are hereby
authorized to issue to the sheriff and surveyor of Carroll county
in this state, all such orders and to make the necessary rules to
enforce the same, as they may from time to lime, find to be
necessary for all such surveys as may be applied for by either
party, in any action now depending in said court, and which
was instituted in the same at any time prior to the establishment
of Carroll county, to recover, or relating to, any real estate in
