June 12th. 1690 (118) ------------------ Of this Court by his certain Bill Obligatory which the sd George and Elizabeth with the seal of the said Jonathan signed bringeth here into Court the date whereof is the day and year aforesd acknowledged him Selfe to bound to the said William Stevens in his life time in the sd full and just Sum of three thousand three hundred thirty and three pounds of tobacco and caske to be paid to the sd William convenient at some place appointed by Act of Assembly on the Bay side in Somerset County at or upon the tenth day of October next ensueing the date of the sd Bill to which payment well and truly to be made the sd Jonathan bound him him selfe firmly by the sd Bill Nevertheless the sd Jonathan the sd Sum of 3333. Pounds of Tobacco and Caske although often demanded the same to the said William in his life time or to the sd Elizabeth while she was Sole nor to the sd George and Elizabeth since the marriage between them had and solemnized nor to any of them hath not tendred, but hath hitherto denyed, and doth stll deny to the damage of the sd George and Elizabeth of 5000 pounds of tobacco and thereof they bringeth their suit &c. After the Declaration Read, the plts. produceth this following Bill --- This Bill bindeth me Jonathan Towers of Somerset County in the Province of Maryland Cooper my Heirs Executers and Administrators to pay or cause to be paid, unto Coll. William Stevens of Somerset County Mercht. his Heirs Executors Administrators or Assigns the full and just Sum of three thousand three hundred thirty three pounds of good sound Merchantable leaf tobacco and caske convenient at Some place appointed by Act of Assembly on the Bay side in Somersett County at or upon the tenth day of October next ensueing the date hereof as Wittness my hand and seal this thirteenth day of October 1686. Jona: Towers. ? seal. - - - Signed Sealed and dilivered. in the presence us. - - - - Robert: Cade. To which abovesd Bill the sd Towers Owns in Court to be his Act & deed Edmund: Howard as also two Bills more, which sd three bills all being due and payable are all owned by the sd Towers. but Complaining sayes he never had any Consideration for those three sd Bills which the sd Layfield produces, all amounting to ten thousand pounds of tobacco. which the sd Layfield proves A Consideration for, by a certain tract of Land called Supply containing three hundred Acres Sold to the sd Towers for the three Bills above mentioned, but he the sd Towers neglecting due paymt of these three Bills, did impead the conveyance of the sd Land called Supply. And therefore the Court Orders the sd Towers to pay unto the sd Layfield, the above sd Bill (viz of thre thousand three hundred thirty and three pounds of tobacco, as also the other two Bills hereafter engrossed, and which makes up the abovesd Bill ten thousand pounds of tobacco & Caske, And that George Layfield make over by deeds of writing that above named three hundred Acres of Land called Supply to the sd Towers. - - - - - - - - - - - - - - - - - - - - - - - - - George: Layfield et Uxor.plts Somersett County Ssc.
