42            VOTES and PROCEEDINGS, November, 1799.

lieu of the third amendment to substitute the following, viz.  After the word "Chalabre" ion the
last line of the second page insert the words " William Delasere."
    The question being propounded, That the senate do assent thereto?  The previous question was
called for and put, Shall the question now be put?  The yeas and nays being called for, appeared
as follow:

So it was determined in the negative
    The bill, entitled, An additional supplement to the act, entitled, An act relating to negroes,
and to repeal the act of assembly therein mentioned, was read teh second time by especial order
and will not pass.
    The resolution in favour of George Chocke was read the second time by especial order and
assented to.
    The senate then took up the reconsideration of the resolution in favour of Darby McNamara,
and assented thereto.
    The bill, entitled, An additional supplement to an act, entitled, An act to regulate the inspection
of tobacco, was read the second time by especial order and will pass with the proposed amendment.
    Amendment proposed.  On the 5th line of the first page after the words " Anne-Arundel county"
insert the words " and at Emerson's warehouse, in Talbot county."
    The two bills and two resolutions next before mentioned were sent to the house of delegates
by the clerk.
    The clerk of the house of delegates delivers to the clerk of the senate a bill, entitled, An act
respecting the free-school of Anne-Arundel county, thus endorsed; " By the house of delegates,
" December 31, 1799:  Read the first time and ordered to lie on the table.
                                                        " By order,                                W.  HARWOOD, clk.
" By the house of delegates, January 2, 1800:  Read the second time and will pass.
                                                        " By order,                                W.  HARWOOD, clk."
A bill, entitled, An act relating to coroners and sheriffs, and a bill, entitled, A further supplement
to the act, entitled, An act for the better administration of justice in the several counties
of this state, severally thus endorsed; " By the house of delegates, January 3, 1800:  Read the
" first and second time by especial order and will pass.
                                                        " By order,                                W.  HARWOOD, clk."
The following resolutions:
By teh HOUSE of DELEGATES, January 3, 1800.
    RESOLVED, That John Gassaway be and he is hereby directed and required, under the direction
of the governor and council, to transcribe such parts of the records in the office of which he
is register as require the same, and have them, together with the records to which they belong,
substantially bound in rough calf; and the governor and council are hereby authorised to draw on
the treasurer for payment of the same, at the rate of eight-pence per side.
                                                        By order,                                  W.  HARWOOD, clk.
By the HOUSE of DELEGATES, January 3, 1800.
    RESOLVED, That the governor council be and they are hereby authorised to employ some
person or persons to stop the leak in the roof of the stadt-house, and to paint the external part,
the expences attending the same to be paid out of the five hundred pounds subject to the appropriation
of the governor and council.

By teh HOUSE of DELEGATES, January 3, 1800.
    RESOLVED, That James Calhoun, Nicholas Rogers, Jesse Hollingsworth, Elias Ellicott and
James Carey, be and they are hereby authorised and empowered to inquire into the situation of
the prisoners confined in the gaol of Baltimore, the cloathing, feeding, management and general
superintendance of the said prisoners, and into any abuses which may have heretofore been
committed in said gaol, and report fully to the criminal court of Baltimore county at their next
sitting, and to the general assembly at their next session, the result of their inquiries as aforesaid.
    RESOLVED, That the governor be requested to furnish the said James Calhoun, Nicholas Rogers,
Jesse Hollingsworth and James Carey, with a copy of the memorial of said prisoners,
preferred to the present house of delegates.

And also the following message and bill therein mentioned.
By the HOUSE of DELEGATES, January 3, 1800.
        GENTLEMEN OF THE SENATE,
    WE accede to all your amendments to the bill for the relief of sundry insolvent debtors, except
the second and third.  We cannot, consistent with principles that included others, exclude
Chalabre and Kerr.  If the senate are in possession of the fats relative to those persons which operate
to their exclusion, we should be glad to be informed of them.  We have no objection to the insertion
of Delasere.
