VOTES and PROCEEDINGS, November, 1799.            41

A bill, entitled, An additional supplement to an act, entitled, An act to regulate the inspection
of tobacco, a bill, entitled, A supplement to the act, entitled, An act for the regulation of officers
fees, and a bill, entitled, An act to restrain sheriffs and others from summoning appraisers
in certain cases, severally this endorsed; " By the house of delegates, January 2, 1800:  Read
" the first and second time by especial order and will pass.
                                                        By order,                                  W.  HARWOOD, clk."
Which were severally read and ordered to lie on the table.
    The bill, entitled, An act to restrain sheriffs and others from summoning appraisers in certain
cases, was read the second time by especial order and will pass.
    The following message was prepared, read and agreed to.

By the SENATE, January 2, 1800.
        GENTLEMEN,
    ON reconsideration, we have receded from our third amendment to the bill, entitled, An act
to aid and revive the proceedings of the court of appeals, and in its room have substituted the
following, which we flatter ourselves will meet with your approbation:  " And be it enacted,
That in all appeals or writs of error to be sued out or prosecuted from and after the first day
of May next, judgment shall be rendered by the court of appeals at the first court, unless it appears
on the face of the record, or by affidavit lodged with them, at said court, that the 
said clause was not removed for the purpose of delay; provided nevertheless, that the said court
may continue any cause to the end of the third court, if at the time of filing bond, and security,
the party appealing, or suing out the writ of error, produce a certificate from two or more respectable
freeholders of his county, that himself and his securities are worth double the debt
or amount of the judgment or decree to be removed."

    The clerk of the house of delegates returns the bill, entitled, An act to appoint an agency for
the year one thousand eight hundred, thus endorsed; " By the house of delegates, December 31,
" 1799:  Read the first time and ordered to lie on the table.
                                                        By order,                                  W.  HARWOOD, clk.
" By the house of delegates, January 2, 1800:  Read the second time and will pass.
                                                        By order,                                  W.  HARWOOD, clk."
Ordered that the said bill be engrossed.
The senate adjourns until 6 o'clock.

    The senate met.
    The resolution respecting the address of president George Washington, the bill, entitled, An
act for the relief of sundry insolvent debtors, with the amendments thereto, and the message respecting
the said bill, were sent to the house of delegates by the clerk.
    The resolution in favour of Samuel Turbutt Wright was read the second time by especial order
and dissented from.
    The resolution in favour of the trustee of the state was read the second time by especial order
and assented to.
    The resolution in favour of the examiner-general of the western shore was read the second time
by especial order and assented to.
    The bill, entitled, An act for the direction of surveyors in executing warrants of escheat in
certain cases, was read the second time by especial order and will not pass.
    The bill, entitled, A supplement to the act, entitled, an act for the regulation of officers fees,
was read the second time by especial order and will not pass.

The senate adjourns until to-morrow morning 10 o'clock.

F    R    I    D    A    Y,    January 3, 1800.

    THE senate met.  Present the same members as on yesterday.  The proceedings of yesterday
were read.
    The bill, entitled, An act to empower the levy court of Prince-George's county to lay off a
road in said county, the bill, entitled, An act relating to certain public roads in Anne-Arundel
county, with the amendments thereto, the bill, entitled, An act to vest certain powers in the
corporation of George-town, in Montgomery county, the bill, entitled, An act to make valid a
certificate of land therein mentioned, the bill, entitled, An act to restrain sheriffs and others
from summoning appraisers in certain cases, the message respecting the amendments to the bill,
entitled, An act to aid and revive the proceedings of hte court of appeals, and the said bill, the
resolution in favour of Samuel Turbutt Wright, the resolution in favour of the trustee of hte
state, the resolution in favour od the examiner-general of the western shore, the resolution respecting
the treasurer of the western shore, and the message respecting said resolution, the bill,
entitled, An act for the direction of surveyors in executing warrants of escheat in certain cases,
and the bill, entitled, A supplement to the act, entitled, An act for the regulation of officers
fees, were sent to the house of delegates by the clerk.
    The following message was prepared and read.
