Sommrsett Ss: Capta: Thomas Jones Late of this County was Summoned to answr unto William ffurnis
in an accon of assalt & Batry ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
And whereupon y said ffurnis by his attorney Thomas Poole Saith yt hee y said Jones in this instant
moneth of June & upon y Sixth Day of y moneth aforesaid in y yeare of or Lord God 1677: Did upon his
Lopps highway against y plantacon of William Turpin in this County make assault & him y said
ffurnis & his wife Did beate wounded & evill intreated that of their lives they Did Despaire & othr harmes
hee Did them to y great Damadge of y plaintift & contrary to y pease & governement of y Proprietorey
whereupon y plaintiff Saith yt hee is Damnified & hath Damadge to y value : Two Thousand nine hun
dred pounds of Tobacco Thereupon brings his Suit: / : ~ ~ ~ prquer: Thomas Poole:
And the said Thomas Jones in his proper person Cometh & Defendeth the force when &c & saith yt hee y said
William his accon ought not to have by reason y said Thomas hath neither forme nor sense to answr unto

there is not ground in Law for him to answr thereunto the which hee is ready to averr & therefore prayes A
