And the said John Anderson this Day to witt y 12th Day of June Annoqe Domini 1677: Cometh & Defendeth
(in his owne person) y force & injury &c & saith yt hee ownes y wrighteing to bee Signed by him but hath
Satisfied all but Seaventy quarters: This Cort orders yt if y Defendant John Anderson prove not all paid
but Seaventy quarters then y said John Anderson to Carry what is Due home to Major John West : / :

Sommrsett Ss: Edward Jones late of this County was Summoned to answr: unto William ffurniss of an accon
of assault & Battery &c: ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
And whereupon y said ffurnis by his Attorney Thomas Poole that hee y said Edward Jones in this
Instant moneth of June & upon y first Day of y aforesaid moneth in y yeare of or Lord God 1677 Did
upon his Lopps highway against y plantation of William Turpin made an assault & him y said
ffurnis & his wife Did beat wounded & evill intreated yt of their lives they Did Despaire & other harmes
hee did them to y great Damadge of y plaintiffe & Contrary to y peace & Government of y Proprietary
Whereupon y plaintiffe Saith that hee is Damnified & hath Damage to y value of Two thousand
nine hundred pounds of Tobacco & thereupon brings his Suit: prquer: Thomas Poole: ~ ~ ~
And the said Edward Jones in his proper person Comes & Defends y force & injury when &c & saith that
y said William his accon ought not to have by reason y said William Doth Declare voide of forme
& substance vizt:
1 There is noe Such place in this province as Somrsett Ss:, itt ought to have beene Somrsett County Ss:
2d of an accon of an assault & Battery which is noe English word nor is there any such accon as (of an
assalt & Batry) besides its Contrary itts Contrary to y originall y originall being assault & Battery:
3d The said indigested words are nonsense & noe Declaracon for (And Whereupon y Said ffurnis by his
attorney Thomas Poole that the the Edward Jones) noe man knowes whoe it is that Declares ~
4th hee ought to have named y yeare of his Lopps Dominion besides y abuseing his Lopp by y name of
Proprietory
5th Contrary to y pease & Governmt of y proprietary the Deft haveing never Disliked any of his Lopps
graine
6 And the plt Saies not yt hee is Damnified by reason of which nonsense & mistakes y Deft Sayes yt by Law
hee is not bound to give any furthr answr thereunto and this hee is ready to aveir & prayes a nonst:
with hs Costs & Damadges in this Case & illegally Sustained: Edward: Jones: :~ ~ ~ ~
Edward ffrye & Margrett Turpin y wife of William Turpin being Subpa: on y part of y plaintiffe ~
appeare and were examined upon oath but not taken in wrighteing: ~ ~ ~ ~ ~ ~ ~
