Sommersett Ss David Dale was summoned to answer unto George
27 Day in A plea of Debt &c
And whereupon the said George Day by his Attourney Geo: Hasfurt
saith That he the said David Dale became Indebted unto him the
said George Day the full and Just quantity of one Thousand eight
hundred pounds of good Sound marchantable tobacco in Caske as pr
A Certaine Instrument (here in Cort: produced) bearing Date the 8th: day
of Aprill Annoq Domini 1674 will more plainely appeare wherein
the said David Dale Did assume upon himselfe and promise to pay
or Cause to be paid the sd: quantity of 1800lb: of tob: To him the said
George Day Conveniently in Somersett County in Pocomoke river
the 20th: of october next ensueing the Date of the said Instrument
& for the True performance thereof bindes himselfe & his heires
By setting his hand to y said writing But he the said David fraudulently
intending to Deceive him the said George of the said one thousand
eight hundred pounds of tobacco in Caske Denyeth & Still doth to pay
the same, The plt: saith he is Damnified and hath Dammadge to
the vallue of Three Thousand pounds of Tobacco in Caske And
thereupon brings his Suite &c ; / ; ~ ~ ~ ~ ~
