to Authorize and empower them on such Hearing and Trial to pro-
ceed to give such Sentence and Judgement as the Articles of War
will Warrant and the said Sentence and Judgement to carry into
execution.
Provided Nevertheless that No Sentence or Judgement be exe-
cuted without a Confirmation of it by the Governor of this State and
that this Commission and Authority be not considered as Authoriz-
ing a Trial of such Offenders as are charged with Ravishment and
Rape.
Given in Council at Annapolis under the Great Seal of this State
this 30 Day of March 1783. — Wm Paca. —

Monday 31st March 1783
Present His Excellency William Paca Esqr Governor. —
Benjamin Stoddert, Jere. T. Chase and James Brice Esquires.
Ordered that the western shore Treasurer pay to William Haney
six pounds six shillings and eight pence specie agreeable to the Act
to adjust the Debts due from this State on Account passed. —
That the said Treasurer pay to Thomas Townsend three pounds,
seven shillings and six pence out of the Money set apart for Contin-
gent Expences per Account passed. —

Whereas Complaints have been preferred to Us charging the Offi-
cers of the Barge Defence with great Misconduct in Boarding a Boat
and seizing and Plundering and Detaining divers Articles therein
found, and also with Plundering the Citizens of this State on some
one of the Islands on the Bay of Chesapeak.
We therefore hereby Constitute and Appoint Captain Solomon
Frazier, Captain Olanyer Delisle, Lieutenants, Zadock Botfield,
George Mignot and William Byus a Court Martial to Hear & Try
the Officers of the said Barge Defence Vizt Capt Daniel Brian,
William Wood and Thomas Birch for the Said Offence and We do
hereby Authorize and empower the Court Martial aforesaid on such
Hearing and Trial to proceed to give such Sentence or Judgement
as the Articles of War will Warrant and to carry the Same into
Execution.

Provided Nevertheless that no such Sentence or Judgement be exe-
cuted without the Confirmation of it by the Governor of this State.
Given in Council at Annapolis under the Great Seal of the State of
Maryland this 31st Day of March 1783
