COMPILED FROM THE ORIGINAL MAPS OF THE SURVEY MADE IN 1858 BY LIEUT. N. MICHLER, U.S. TOPl. ENGrs. UNDER THE DIRECTION OF THE PRESENT COMMISSIONERS OF THE TWO STATES AND FROM MAPS AND OTHER DATA OBTAINED FROM THE OFFICE OF THE U.S. COAST SURVEY BY JOHN DE LA CAMP, C.E. 1860 (NO CARTOUCHE, RIGHT OF CENTER AT TOP). SCALE OF 10 MILES ON A PROJECTION OF 1:128,000 (BELOW TITLE). "ENGRAVED BY W.H. DOUGAL." (RIGHT BOTTOM MARGIN, OUTSIDE NEAT LINE). "PUBLISHED BY AUTHORITY OF THE EXECUTIVE OF MARYLAND" (BOTTOM RIGHT CORNER). "THOs. J. LEE COMMISSIONER" (IN SCRIPT, BELOW THE PUBLISHER'S STATEMENT). "900" (LEFT BOTTOM MARGIN, OUTSIDE NEAT LINE, APPARENTLY STAMPED ON). LONGITUDE WEST FROM GREENWICH (TOP AND BOTTOM BORDERS). LATITUDE (RIGHT AND LEFT BORDERS).
THE INTERVENTION OF THE WAR DELAYED THE SETTLEMENT OF THE DISPUTE UNTIL 1873, WHEN EXTENSIVE ORAL TESTIMONY WAS TAKEN FROM LOCAL RESIDENTS. FINALLY, IN 1877, A THREE MAN ARBITRATION PANEL (WITH ONE DISSENT) DECIDED ON A BROKEN LINE THAT PUT PART OF SMITH'S ISLAND IN VIRGINIA AND GAVE ALL THE LAND AND MARSH NORTH OF CEDAR STRAITS AND WEST OF THE POCOMOKE RIVER TO MARYLAND AND SHARED TANGIER SOUND BELOW JAMES ISLAND AND POCOMOKE BAY BETWEEN THEM. THE BOUNDARY DEFINED IN THIS ARBITRATION HAS REMAINED IN TACT, BUT WAS LATER SUPPLEMENTED BY COOPERATIVE OYSTER BED AGREEMENTS BETWEEN THE STATES.
