that the said Edward Erberry be tyed to the apple tree before the house
of assembly and be there publicly whipt upon the bare back with thirty-nine
lashes
[and further ordered]
that the said Erberry, after he is whipt, be brought into both houses
of Assembly, publicly to ask them forgiveness.
[and finally]
ordered by the Upper House of Assembly that Edward Erberry doe pay for fees to John Gittings, Clerk of the Upper House, 308# tobacco, to William Bretton, Clerk of the Lower House, 216# tobacco, and to Mr. Fitzallen (whose shirt he tore) 100# of tobacco, in all 624# tobacco.
