Schmahl
was a private investigator for the defense before
the first trial. FBI documents obtained in 1975
showed that Schmahl was meeting regularly with
prosecutor Thomas
Murphy and the FBI during this time,
turning over information he had found along
with regular working papers of the defense.
For Schmahl to have worked as an FBI "mole"
was a violation of Hiss's Sixth Amendment right
to a fair trial.
