Biography:
Born October 29, 1839 in New York City. Attended public schools. Studied law; admitted to the bar in 1860. Married, Della (b. 9/1857). Four children: Allan Rutherford (b. 6/1882); Nellie B. Rutherford (b. 8/1883); Reginald Rutherford (b. 9/1885); Grace G. Rutherford (b. 11/1890). Died April 28, 1900 in Washington, D.C. Buried Arlington National Cemetery, Washington, D.C.
Allan Rutherford first gained prominence during the United States Civil
War. In 1861, Rutherford enlisted as a private in the Ninth New York Regiment.
He attained the full rank of colonel, and was brevetted brigadier-general.
Rutherford was wounded in action, sustaining a gunshot wound to the head
during the battle of Second Bull Run. After the war, Rutherford was
commissioned as a Captain in the regular army, where he served until his
resignation in 1870, when appointed Third Auditor of the Treasury by President
Ulysses S. Grant. He served in the Treasury Department until the end
of Grant's term in 1877. Rutherford attended two Republican National
Conventions, 1876 and 1892, and practiced law in Rockville and Washington
prior to election as Clerk of the Court of Appeals in 1897. In the
1897 election, Rutherford defeated sitting clerk J.
Frank Ford, during a Republican sweep through Maryland. Rutherford
died in office, and Ford was appointed as his replacement. As a tribute
to Rutherford, the flag on the dome of the State House was lowered to half-mast.
