The which plea & demurrer being read & by y^e Court heard and fully Understood Judgm^t.
is Awarded to y^e Said plaint. for his Debt & Cost of Suite
Therefore it is Considered by y^e Court here Viz^t. y^e Twenty Eight Day of Novem^r. Anno
Domⁱ. 1700 That y^e Said Plaint John Dowdall have Execution against y^e Estate of y^e S^d.
James Smith as well for y^e Said Sume of forty & Eight pounds of Tob^o. debt as alsoe y^e
Sume of Two hundred Sixty & nine pounds of Tob^o. cost of Suite

Comand was given to y^e Sher^f. of Kent County y^e 26. day of June Annoq Domⁱ. 1700 That he take
Walter Lodge of S^d. County Chirurgion if found in Your bailiwick & him Safe Keep so that you have his
body before his Maj^ties Justices at y^e next Court to Answer unto Ralph Steavenson of Talbott County
Inholder of a plea of Trespass upon y^e Case
Att which next Court Viz^t. y^e 27 day of August Annoq Domⁱ. 1700 y^e day of y^e Returne of Said
writt came Elias King high Sher^f. of Said County & made returne thereof in these words Viz^t.

On which Said day y^e Said Defend^t. by Richard Macklin his Att^ry Appears & prayes thereof to Imparl[e]
[un]till y^e next Court which was granted unto him & Same day was given y^e plaint likewise
[T]he which cause being Continued from Court to Court untill this p^rSent Court came as well y^e Said
Plaint. by Michael Earle his Att^ry as alsoe y^e Said Defend^t. by his Said Att^ry & y^e Said Cause

in Maryland	Steavenson of Talbott County Inholder of A plea of Trespass upon y^e Case

And Whereupon the Said Ralph by Michael Earle his Att^ry Saith that Whereas the Said Ralph by Lawfull
Lycence granted unto him by y^e Justices of the S^d. Talbott County Court hath Kept an Ordinary or house of
Entertainm^t. in Talbott County Afs^d. Ever Since y^e 25. day of August Anno Domⁱ. 1698. untill y^e 10^th.
[da]y of August 1700 In which time (to witt, on y^e 7^th. day of August Annoq Domⁱ. 1699 and at divers &
[su]ndry times Afterwards continuing untill y^e 16. day of Jan^ry. Anno Domⁱ. 1699 in Talbott County Afs^d.
[wi]thin y^e Jurisdiction of this Court y^e Said Ralph at y^e Sp^ll. instance & request of y^e Said Walter Sold &
[de]livered unto him y^e. Said Walter divers quantities of Liquors & other Ordinary Accomodacons & alsoe at y^e
[li]ke Instance & request in y^e Yeare of our Lord 1699 Afs^d. And Wihtin y^e jurisdiction Afs^d. y^e Afs^d. Ralph
[so]ld and delivered unto him y^e Said Walter divers Valluable Comodities; All which Ordinary Accomoda:
[:co]ns And Comodities Appeares by an Acc^t. hereunto Annexed & here in Court brought Amounting
[in] the whole to the Sume of Six hundred ninty Three pounds of Tob^o. In consideration Whereof y^e Said
[W]alter upon himself Assumed and unto y^e Said Ralph faithfully p^rmised that he the Said Walter y^e
[A]fs^d. y^e Afs^d. Sume of Six hundred ninety & three pounds of Tob^o. unto him y^e Said Ralph he would
[w]ell & truly pay when thereunto Afterwards required Yet nevertheless y^e Said Walter his faire
promise & Assumption before made not minding nor in any manner Reguarding but plotting contriv:
[:i]ng & fraudulently intending him y^e Said Ralph in this behalfe Craftily & Subtilly to decieve &
[d]efraud & Afs^d. Sume of Six hundred ninty & three pounds of Tob^o. unto y^e Said Ralph he hath not
[p]aid altho often Demanded but y^e Same to pay he hath Denyed & refused & Still doth deny & refuse
[an]d Unjustly Detaine [to y^e Da]mage of y^e Said Ralph one Thousand three hundred pounds of Tob^o &
