Therefore it is Considered by ye Court here vizt. this 27 Day of March
Annoq Domi. 1701 That ye Said Defendants William Whitehead and Anna his
wife as to ye Said Action goe thereof without Day and it is likewise Considered
that ye Said Defendants doe Recover from ye Said Plaintf. Edward Bathurst
as well ye Sume of fifty pounds of Tobo. for A Nonsuite as alsoe ye Sume of Two
hundred and Six pounds of Tobo. cost of Suite According to Act of Assembly &a. & ye Said
Edward Bathurst in Mercy                                                    Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye Twenty fourth Day of Septemr. Annoq
Domi. 1700 that he Take Wm Whitehead and Anne his wife alius dictus William
Whitehead and Anne his wife Admrs of all & Singular the goods Chatles and Creditts of
Richard Wallis late of Said County Carpenter Decd. if found in his bailiwick & them
Safe keepe Soe that he have theire bodies before our Justices at ye Next Court to be
held for Said County ye fourth Tuesday of Novemr. Next to Answer unto Edward
Bathurst of ye Citty of London merchant of A plea of Debt &a.

Att which next Court vizt> ye 26. Day of Novembr. ye Day of ye returne of Said
writt came Elias King high Sherf. of Said County & made returne thereof in these
words vizt.                                     Cepi Corpus       Elias King Sherf.

On which Said Day ye Said Defendts. by Richard Macklin theire Attry Appeares
and prayes thereof to Imparle untill ye Next Court which was granted unto him ye
Same day was given to ye Plaintf. likewise         Earle pr qr.

Which cause being contd. from Court to Court untill this prsent Court vizt. ye 27
day of March Annoq Domi. 1701 and ye Said Cause now Standing for Tryall came
as well ye Said Defendants by theire Said Attry as alsoe ye Said Plaintf. by his Said
Attry ye Plaintf. Decln. vizt.

Kent County     Ss    William Whitehead & Anna his wife adrs of all & Singular ye goods
in Maryland    Chattells & Creditss of Richd Wallis late of Sd County Cooper

   deceased was Summoned to Answer unto Edwd: Bathurst of ye: Kingdome

   of England Mercht of a Plea that they rendr: unto him the just Sume

   & neat quantity of nineteen hundred thirty five pounds of good

   Sound merchantable well quallified bright Tobacco & Caske wch: from

   him they unjustly detaine
and whereupon the Sd Edwd by Michl: Earle his attorney Saith that whereas the
Sd Richd. in his lifetime to witt the 15th. day of August Annok Domy 1697 in Sd
County wth: in the jurisdiction of of this Court by his certain bill or wrighting obligatory
Sealed wth: his Seale as his act & Deed deliverd & here in Court brought whose date is
the Same day & yeare did bind himselfe his heirs Exrs. or Adrs. the Aforesd: Sume of
nineteene hundred thirty & five pounds of Tobo. quallified as Afsd. convenient in Kent
or Ceecill County Yet notwithstanding ye Said Richard in his life time ye Afsd. Sume of
nineteen hundred thirty & five pounds of Tobo. according to ye tenr. of ye Same bill unto ye Sd.
Edward he had not payd altho often demanded neither did ye Said Anne when Sole
after ye decease of ye Said Richard pay ye Same although often required although
letters of Administracon were to her granted &a.    Neither hath ye Said William
and Anna nor either of them Since intermariage paid ye Said 1935 Tobo although
