November Court 1700: No: 5 [17] Command was given to ye Sherf of Kent County ye 28 day of March Anno Domi 1700 [That he] Take Sollomon Wright admr: of James Smith late of Kenty County Gentn. [Decd] if found [in his] bailiwick and him Safe keep Soe that he have his body before our Justices of ye next Court to [be] held for our Said County to Answer unto Edward Cheatham of A plea of Trespass upon ye Ca[se] Att Which next Court Vizt. ye 25 day of June Anno Domi: 1700 ye Day of ye returne of [ye writ] came Elias King high Sherf of Said County and made returne thereof in these Words Vizt. Cepi corpus pr Elias King Sherf. On which Said day came ye Said Defendt. and in his prper prson &: prayes thereof to Imparle [until] ye Next court which was Granted unto him ye Same day was given to ye plaint. alsoe Macklin pr [qr] The which cause being cont. from Court to Court untill this prsent Court came as well ye Said Defendt. in his prper person as ye Said Plaint. by his Said Attry & ye Said Cause Now [standing] for Tryall The plaint. And Whereupon the Said Edward Cheatham by Richard Macklin his Attry complained that whereas ye Said Edward ye 30 day of May Anno Domi 1699 and for a long time before that time [had] attained to Some Knowledge and Skill in Chirurgery and in the Administration of phisick and whe[reas] the Said James in his lifetime and a certaine Francis Servent to ye Said James and a Certaine Oliver & Thomas Servants to ye Said James and a Certaine Woman Servant of ye Said James & James Smith Junr. Son to ye Said James Was between ye Afsd. 30 day of May Anno Domi 1699 [& ye] ninth of Aprill Anno Domi 1700 Under Divers indispositions of body being greatly afficted with Severall distempers, and in consideracon thereof ye Said Edward Cheatham ye Afsd: 30 day of May Anno [Domi] 1699 and continuing Untill ye ninth day of Aprill Anno Domi 1700 at Chester River in Kent County within ye jurisdiction of This Court at ye Spll Instance & request of ye Said James Smith Senr. Would [do] his uttmost indeavour to Cure the Said James Smith together wth. his Afsd. Servants and Son and amin[ister] Such Medicines and apply Such pleysters as was proper to Cure theire divers distempers under which they languished that then ye Said James Smith Senr. upon himselfe Assumed and unto ye Said Edwd. Cheatham he faithfully promised that he ye Said James for ye Severall Medicines and implaysters and ye labour [illegible] indeavours of him ye Said Edward in that behalfe to be taken well & truly would content & pay Unto ye Sa[id] Edward Soe much good Tobo. & Casque as ye Said Edward Should reasonably deserve when he ye Said James S[enr] Should be thereto Afterwards required & ye Said Edward in fact Sayes that he giving Creditt to ye pro[mise] and Assumption Afsd. of ye Said James and relying thereupon he did Apply Severall implaysters and administer divers Medicines fitt & proper for ye cureing of ye Said James and his famelly (above recited) and alsoe did use his best endeavours to cure ye Said James & family of theire Sevll. infir[mi:] :ties for all which ye Said Edward Sayes he reasonably doth deserve to have ye Sume of Three Thousand two hundred & Sixteen pounds of Tobo. and alsoe at the like instance and request of ye Said James in [?] Chester River Afsd. within ye jurisdiction Afsd. ye Said Edward had lent unto ye Said James Smith [ye] Sume of Two hundred & Sixteen pounds of Tobo. and also had at ye Instance & request of ye Said Ja[mes &] within ye jurisdiction & for ye proper use & behoofe & Service of ye Said James given Creditt to S[undry] persons for one Thousand one hundred & Twelve pounds of Tobo. in consideracon Whereof ye Said Ja[mes] in his lifetime upon himselfe Assumed and Unto ye Said Edwd. faithfully promised that he ye Sd. Ja[mes] ye Said Sumes of 216lbs & Tobo & 1112lbs Tobo. when thereunto Afterwards Required would well & truly pa[y] and ye Afsd. Sumes of 216lb. Tobo. & 1112lb Tobo amounts in ye whole to ye Sa[id] [four thou]sand five hund[red] and forty four pounds of Tobo. as by A particular Acct of ye Sevll. Medic[ines] [implayst]ers Tobo lent a[nd] Creditts given to this Decln. Annexed & here in Court brought ye Same [?] [illegible] and altho ye Sd. [James] in his lifetime did pay & Satisfie unto ye Said Edwd. one thousand nine hundred pounds of Tobo in [part?] of ye Said Sume of 4544lb Tobo. Yet as to ye residue being Two Thousand Six hundred forty & four [pounds] of Tobp. ye Said James his Afsd. Severall promises & Asumptions not minding or regarding but [illegible] 2644lb Tobo. residue as Afsd. unto ye Afsd. Edwd ye Said James in his Lifetime Did not [pay] [illegible] hath ye Said Solomon in his Said Capacity Since ye Death of ye Sd James [ye Sd] Sume of 2644lb Tobo altho often demanded but ye Same to him to pay hath and Still doth deny [&?] unjustly detaine to ye damage [?] [illegible] [illegible line of text] |
