The which Decln. & demurer being read and argued and by ye Court fully heard & understood
ye Said Defendt. by his Afsd. Attry moves ye Court for A Nonsuite which was granted

Therefore it is Considered by ye Court here vizt. this 28. day of Novemr. Annoq Domi. 1701
that ye Said Defendt. Edward Stevenson as to ye Said action goe thereof without day & it is
likewise considered that ye Said Defendt. doe recover from ye Said Plaintf Thomas Cooke as
well ye Sume of fifty pounds of Tobo. for A Nonsuite according to Act of Assembly in that case
made and provided &a. as alsoe ye Sume of Two hundred Sixty & nine pounds of Tobo
cost of Suite and ye Said Thomas Cooke in Mercy ~~~~                 Jno Dowdall Clk

Stephen Austin    Comand was given to ye Sherf. of Kent County ye 26. day of Augt. anno
ast    Domi. 1701 That he Take James Theslewood late of Dorchester County
James Theslewood    planter if found in his bailiwick & him Safe keepe Soe that he have
his body before his Majties Justices at ye next Court to be held for Said County to answer
unto Stephen Austin of A plea of Trespass upon ye Case
Att which next Court vizt. ye 23d. day of Sepr. Anno Domi. 1701 ye day of ye returne of
Said writt came Elias King high Sherf. of Said County & made returne thereof vizt.

The which cause being contd. untill ye prsent vizt. ye 28 day of Novemr. Anno Domi. 1701
came as well ye Said plaintf by Michael Earle his Attry as alsoe ye Said Defendt. by
Richard Macklin his Attry and ye Said cause Standing for Tryall ye plaintf Decln.
Kent County in Maryland Ss    James Thistlewood late of Dorchester County planter Stands
     Attached to answer unto Stephen Austen of A plea of Trespass upon ye case
And whereupon ye Said Stephen by Michael Earle his Attry complaineth & Saith that whereas
ye Said James on ye 10. day of Febry Annoq Domi. 1699 and at divers times afterwards
continuing untill ye 20. day of May Anno Domi. 1700 in Dorchester County Afsd. within ye
Jurisdiction of this Court at ye Spll. instance and request of ye Said James had Sold & delivered
unto him ye Said James by ye Said Stephen divers wares goods & Merchandizes & alsoe at ye like
Instance and request within ye time Afsd. & within ye jurisdiction Afsd. ye Said Stephen paid
unto a Certain John Manatt for ye proper use of him ye Said James ye Sume of fifty pounds
of Tobo. all which goods wares & Merchandizes Sold & delivered and Tobo. paid Amounteth in ye
whole to ye Sume of Two thousand one hundred Twenty & eight pounds of Tobo. as pr an Acct.
hereunto annexed & here in Court brought ye Same Appeares In consideration whereof ye
Said James upon himselfe Assumed & unto ye Said Stephen faithfully promised that he ye
Said James ye Afsd. Sume of Two thousand one hundred twenty & eight pounds of Tobo. unto
ye Afsd. Stephen he would well & Truly pay when thereunto Afterwards required yet
nevertheless ye Said James ye Afsd. Sume of 2128. Tobo. according to his promise & Assumption
unto ye Said Stephen he did not pay altho often demanded but ye Same to pay he hath denyed &
refused and Still doth deny and refuse & unjustly detaine to ye Damage of ye Said Stephen
four thousand pounds of Tobo. and thereupon he brings this Suite ~~   Jno Doe
