Kent Ss    Joshua Sweatnam Stands Attached to answer unto Charles Hollinsworth Junr
                of A plea of Trespass upon ye case
And whereupon ye Said Charles by Richard Macklin his Attry complaines that whereas ye Sd.
Joshua to witt ye Second day of Febry Anno Domi. 1699 and ye 3d. day of May Anno Domi. 1700
at Chester river in Kent County within ye Jurisdiction of this Court in consideracon that ye Afsd.
Charles at ye Spll. Instance & request of ye Afsd. Joshua would receive into his house at Chester Afsd.
ye Afsd. Joshua as a Sojourner with him ye Said Charles and ye Same Joshua would find & give
meat drink lodging and washing as long as they ye Said Joshua & Charles Should please & alsoe
Take up out of ye woods and geald a certaine horse appertaining to ye Said Joshua ye Said Joshua
upon himselfe Assumed & unto ye Said Charles faithfully promised that he ye Said Joshua
would well & faithfully content & pay unto ye Said Charles Soe much for his meat drink
lodging and washign Afsd. for Such & Soe long time as ye Said Joshua wth. ye Afsd. Charles in the house
of him ye Said Charles as A Sojourner Should remaine as he ye Said Charles Should reasonably
thereof deserve and likewise Soe much as ye Said Charles for Takeing up & guilding ye Afsd. horse
of ye Afsd. Joshua as ye Said Charles for ye Same Should reasonably deserve and ye Said Charles in
fact Saith that he ye Said Charles at ye Afsd. instance and request of ye Said Joshua into his
house at Chester Afsd. ye Said Joshua as A Sojourner wth him ye Said Charles he did receive &
that ye Said Joshua in ye house of him ye Said Charles as a Sojourner ye Space of Three months
did remaine and that he ye Said Charles did find and give to him YY Said Joshua Meat drink
washing & lodging Afsd. by ye whole time Afsd. in ye house of him ye Afsd. Charles and alsoe did at
Chester river Afsd. Take up out ye woods & guild a certaine horse Appertaining to ye Afsd. Joshua
and ye Said Charles further in fact Saith that he ye Said Charles for ye meat drink washing &
lodging Afsd. to ye Afsd. Joshua for ye Afsd. Three Months doth reasonably Deserve to have three
hundred pounds of Tobo. and for ye Afsd. Takeing up & guilding of ye Afsd. horse he Saith he doth
reasonably deserve ye Sume of four hundred pounds of Tobo. which Afsd. Severall Sumes in ye
whole amounts to ye Sume of Seaven hundred pounds of Tobo. as by an Acct. to this Decln. annexed
& here into Court brought ye Same Appeares yet ye Afsd. Joshua little regarding his Afsd.
Assumption & promise but plotting and fraudulently designing ye Afsd. Charles in that behalf
craftily & Subtilly to deceive & defraud ye Afsd. Joshua ye Afsd. 700lb Tobo. unto ye Afsd.
Charles altho often required hath not rendered but ye Same to him hitherto to render hath &
as yet doth deny & refuse whereupon ye Said Charles Hollinsworth Sayes he is damnified &
hath damage to ye value of 1400lb. Tobo. & thereupon he brings this Suite
