Defendant makeing noe manner of defence neither by him Selfe nor Attry Judgt. is granted for ye Said plaintf. upon his Attrys prayer for ye balle. appearing due upon ye plaintf. Acct. which Acct. was Endorsed vizt March ye 28. 1701 Then came before us Thomas Smith and Charles Hynson Two of ye Justices of Kent County ye within Edward Bathurst and deposed upon ye holy Evangelists that ye within Acct. is Just & True and noe part thereof recd. but there is due Credt. given for Except Some Ordinary Accomodacons ye Sume not knowne therefore cannot give Creditt for it Thomas Smith Charles Hynson Therefore it is Considered by ye Court here this day vizt. this 28. day of Novemr. Annoq Domi. 1701 That ye Said plaintf. Edward Bathurst doe recover from ye Said Defendt. Isaac Caulk as well ye Sume of one Thousand Seaven hundred & Seaven pounds of Tobo. Debt as alsoe ye Sume of Two hundred eighty & three pounds of Tobo. cost of Suite and ye Said Isaac in Mercy ~ ~ ~ ~ Jno Dowdall Clk ~~~~~~~~~~~~~~~ Comand was given to ye Sherf. of Kent County ye 29 day of March Annoq Domi. 1701 that he Take Charles Hollinsworth alius dictus Charles Hollinsworth Junr. of Kent County if found in his bailiwick & him Safe keepe Soe that he have his body before our Justices at ye next Court to be held for Said County to answer unto Wm Burris of A plea that he render him one horse of Two yeares old cut & dockt which &a. Att which next Court vizt. ye 24 day of June Anno Domi. 1701 ye day ye returne of Said Writt came Elias King high Sherf. of Said County and made returne cepi pr Elias King Sherf. On which Said day ye Said Defendt. by Michael Earle his Attry appeares & prayes thereof to Imparle untill ye next Court which was granted ye Same day was given ye plaintf. alsoe ~~~~~ Macklin pr qr. The which cause was Contd from Court to Court untill this prsent Court vizt. ye 28 day of Novemr. Annoq Domi. 1701 and now came as well ye Said Defendt. by his Said Attorney as alsoe ye Said Plaintf. by his Afsd. Attry and ye Said Cause Standing for Tryall ye plaintf. Decln vizt. Kent Ss Charles Hollinsworth alius dictus Charles Hollinsworth Junr. of Kent County was Sumoned to Answer unto Wm Burris of A plea that he render him one horse of Two yeares Old cut & dockt which to him he oweth & from him he unjustly detaines |
