James Williames    And ye Said Defendt. by Michael Earle his Attry comes & defends ye
ast    force & injury when &a. and for plea Saith that he did not Assume
Emanuel Cleave    and of this he putts himselfe upon ye Country ~ ~ Earle pr Defendt.

But ye Plaintf. not being able to mentaine his Action nevertheless of ye Issue before
Joyned not having Suffitient Evidence to prove ye Matter Suffereth A Nonsuite

Therefore it is Considered by ye Court here vizt. this 28. day of Novemr Annoq Domi. 1701
that ye Said Defendt. Emanuel Cleave as to ye Said Action goe thereof without Day and
it is further considered that ye Said Defendt. doe recover from ye Said Plaintf. James
Williames as well ye Sume of fifty pounds of Tobo. for A Nonsuite According to Act of
Assembly in that case made & provided as Alsoe ye Sume of Two hundred and Two

Comand was given to ye Sherf. of Kent County ye 13. day of Febry Anno Domi. 1700 that by good
and Lawfull men of his bailiwick he make knowne unto Thomas Tagg and Susanah his wife Exrs
of ye last will & Testamt. of Denis Canty late of Said County Decd. if found in yr. bailiwick Soe
that they be and personally Appeare before our Justices at ye next Court to be held for Sd
County to Shew cause if any they have why Execution Should not Issue forth ast. them to
Satisfie unto James Mitchell as well ye Sume of five hundred & Sixty pounds of Tobo.
Debt as alsoe ye Sume of Two hundred Sixty & Eight pounds of Tobo. Cost According to
[a] Judgt. recovered ast. ye Said Denis Canty in his life time Att a Court held for Said County
[ye] 28 day of March Annoq Domi. 1699
Att which next Court vizt. ye 25 day of March Annoq Domi. 1701 ye Day of ye returne of
Said writt came Elias King high Sherf. of Said County and made returne thereof vizt
Made knowne to ye within named Thomas Tagg and Susanah his wife before James Smith &
Mathew Smith Two good and Lawfull men of my bailiwick as by this writt I am comanded
                                                                                      pr    Elias King Sherf.
On which Said day ye Said Defendts. by Michael Earle theire Attorney Appeares &
prayes thereof to Imparle untill the next Court which was granted ye Same day was
given ye plaintf. likewise    Macklin pr qr
The which cause being contd. from Court to Court untill this prsent Court & ye Said
cause Standing for Tryall came as well ye Said Defendants by Michael Earle theire
Attorney as alsoe ye Said Plaintf. by his Said Attry & ye Said Defendts. makeing
noe Suffitient defence ye Plaintf. by his Said Attry prayes that ye Said Judgemt. may
be Affirmed which was accordingly Granted

Therefore it is considered by ye Court here this day vizt ye 28. day of Novemr. Annoq
Domi. 1701 That ye Plaintf. James Mitchell have Execution ast. ye Said Defendts.
Thomas Tagg and Susanah his wife Exrs of ye last will & Testamt. of Denis Canty Decd.
as well for ye Afsd. Sume of Eight hundred Twenty & Eight Debt & Cost as afore Said
as alsoe ye Sume of Two hundred & Seaven pounds of Tobo. cost of Suite & ye Said
