November Court 1700 [21] Comand was given to ye Sherf. of Kent County ye 27. day of August Anno Domi. 1700 that he take Jame[s] Daulton of ye Said County Planter if he Should found in his bailiwick & him Safe keep Soe that he have hi[s] body before his majties Justices at ye then Court Sitting to Answer unto Thomas Bulcock of A plea of Trespass upon ye Case On which Day came Elias King high Sherf. of Said County ye Day of ye Returne of Said writt and made returne thereof in these words Vizt. cepi corpus pr Elias King Sherf. The which cause was Continued from Court to Court untill this prSent Court Vizt. & 28. day of Novr. Annoq Domi. 1700 and now ye Said Cause Standing for Tryall ye Plaint. Decls
James Att Chester River within ye Jurisdiction of this Court & Twenty Second day of Apll. Anno Domi. 1699 by his Certaine Script or bill whose Date is ye Afsd. day & yeare & hereinto Court brought did oblidge himselfe his heires Exrs. or Admr. to pay unto ye Said Thomas Bulcock or order ye Sume of five hundred and twenty pounds of good merchantable Tobo. in Casque Upon demand in consideracon thereof ye Said James upon himself Assumed & unto ye Said Thomas faithfully did promise that he ye Said James when thereunto required ye Said Sume of five hundred & twenty pounds of Tobo unto ye Said Thomas he would pay yet notwithstand :ing ye Said James the Said five hundred & twenty pounds of Tobo. According to ye tenr. of ye Same bill or Script hath not paid Altho often Demanded but ye Same to pay hath denyed and Still doth deny & refuse to ye damage of ye Said Thomas one Thousand pounds of Tobo. and thereupon he brings this Suite Jno Doe Macklin pr qr. pledges &a. Richd Roe And ye Thomas Bulcock Plaint. by his Said Attorney prayes that ye Said Defendant James Daulton might Appeare & Answer to his Decln. who being Called came not nor any for him but made Default wherefore Judgemt. was awarded for ye Said Sume of five hundred & Twenty pounds of Tobo & Cost Therefore it is Considered by ye Court here Vizt. ye 28. day of Novemr. Anno Domi. 1700 That ye Said Plaint. Thomas Bulcock doe recover from ye Said Defendant James Daulton as well ye Sume of five hundred & Twenty pounds of Tobo. Debt as alsoe ye Sume of Two hundred Twenty & Nine pounds of Tobo. cost of Suite and ye Sid James Daulton in mercy Jno Dowdall Clk Comand was given to ye Sherf. of Kent County ye 25 day of Janry Anno Domi. 1699 alsoe ye 27. Day of March Anno Domi. 1700 That he take James Donavant alius dictus James Donavant of Chester in ye County of Kent in ye Province of Maryland planter if he Should be found in his bailiwick & him Safe keep Soe that he have his body before his majties Justices at ye next Court to be held for Said County to answer unto Flower Walker of old England Tinnplateworker of A plea that he render unto him & full & just Sume of five hundred forty & five pounds of Tobo. in Casque &a. Att which Next Court Vizt. & 26 day of March Anno Domi. 1700 alsoe ye 25 day of June Anno Domi. 1700 ye Day of ye returne of Said writt came Elias King high Sherf. of Said County & made returne of Said writt in these words Vizt. Non Est Inventus pr Elias King Sherf. Comand was likewise given to ye Sherf. of Kent County ye 27. day of August Anno Domi. 1700 That he tak[e] James Donavant alius Dictus James Donavant of Chester in ye County of Kent & Province of Maryland Planter if found in his bailiwick & him Safe keepe Soe that he have his body before his majties Justices at this prSent Court to Answer unto Flower Walker of old England Tinn plateworker of A plea that he ren[der] him ye full & just Sume of five hundred forty & five pounds of Tobo in Casque &a On which Said Day ye day of ye returne of Said writt came Elias King high [Sherf. of] Said County & made returne thereof in these words Vizt/ Cepi Corpus pr Elias Ki[ng Sherf.] The which cause was continued untill this prSent Court & ye Said Defendant comi[tted into] Custody for want of bail And now here at this Day Vizt. & 28. day of Novemr. Anno Domi. 1700 Ca[me ye] Plaint. Flower Flower Walker by Richard Macklin his Attry and the Said Defendant James [Donavant] neither by himselfe nor his Attry Came but mad Default wherefore Judgement was awarded for ye Said Debt & Cost of Suite Therefore it is Considered by ye Court here Vizt. ye 28. Day of Novemr. Anno Domi. 1700 That ye Said Plaint. Flower Walker Doe recover from ye Said Defendant James Donavant as well ye Sume of five hundred forty & five pounds of Tobo.
