Comand was given to ye Sherf. of Kent County ye Thirteenth Day of Febry Anno
Domi. 1700 that he Take Nathanll. Cleave and hannah his wife Exrs to Richard
Scrivner late of Kent County Decd. if found in his bailiwick and them Safe keep
Soe that he have theire bodies before his majties Justices at ye next Court to
be held for Said County to Answer unto Anne Smith Exx. of ye last will &
Testament of Edward Smith late of Kent County Decd. of A plea of Trespass upon
ye Case
Att which next Court vizt ye 25. Day of March Annoq Domi. 1701 ye day
of ye returne of Said writt came Elias King high Sherf. of Said County & made
returne thereof in these words vizt.    Cepi Corpus            Elias King Sherf.

On which Day ye Said Defendants by Richard Macklin theire Attry appears
and prayes thereof to Imparle untill ye next Court which was granted unto them
ye Same day was given ye Plaintf. likewise                 Earle pr qr.

And now here at this Day vizt. ye 25. Day of June Anno Domi. 1701 came as well
ye Said Defendants by theire Said Attry as alsoe ye Said Plaintf. by Michael
Earle her Attorney & ye Said Cause Standing for Tryall ye Plaintf. Decln
Kent Ss    Nathaniel Cleave & Hannah his wife Exrs to Richard Scrivner late

   of Kent County Decd. Stands Attached to Answer unto Anne Smith Exx.

   of ye last will & Testament of Edward Smith late of Same County Decd. of

   A plea of Trespass upon ye Case

And Whereupon ye Said Anne by Michael Earle her Attry complaineth & Saith
that ye Said Richard in his lifetime in ye yeare of our Lord God 1695 was Indebted unto ye
Said Edward the full & just Sume of Three thousand three hundred pounds of Tobo for
& inconsideracon that the Said Richard did promise & Assume to doe Soe much work for ye Sd.
Edward as Should be worth & deserve ye Afd. Sume of Tobo. in Carpenters & joyners
worke and ye Said Richard in his lifetime did Erect A paire of Smalle Staires in ye
Said house & plaine & lay downe about Eight hundred foot of plank upon ye flores to
ye value of twelve hundred pounds of Tobo. but as to ye residue of ye Said Acct he in his
lifetime in work nor any other waies unto ye Said Edward did not pay nor ye Said
Exrs Since his death by meanes Whereof Action hath accrewed unto ye Said Exx. of
ye Said Edward Since his Death to require to have of ye Exrs. of ye Said Richard Soe much
work done as Amounts to ye residue or to have ye Same in Tobo. which have been denyed
hitherto to ye Damage of ye Said Anne in her Capacity four Thousand pounds of Tobo.
and thereupon She brings this Suite         Earle pr qr.    pledg &a. Jno Doe Rd. Roe

To your bill dated in ninety Three 600
To eight barrells of Corne at 100 pr barll 800
