68 June Court 1701 And ye Said Defendt. by Richard Macklin one of ye Attrys of this Court moves ye Court that ye Said Plaintf. Danll. Pearce being a foreigner may put in Security to pay Costs if he does not mentaine his Action which was Granted And it was Thereupon Ordered That ye Said Plaintf. Danll. Pearce doe put in baile to pay Costs if in Case he does not Mentaine his Action Jno Dowdall Clk And upon which motion & ordr. being by ye Court passed Michael Earle Attry of ye Said Plaintf. Danll. Pearce comes into Court and oblidgeth himselfe that he will pay all ye Costs Accrewing upon ye Said Action now depending between ye Said Plaintf. Danll. pearce & ye Said Defendt. William Hollinsworth in Case ye Said Danll. doe not Mentaine his Action Soe as Afsd. brought On which Said Day ye Said Defendant by Richard Macklin his Attry Appeares & prayes thereof to Imparle untill ye Next Court which was granted unto him ye Same day was given ye Plaintf. likewise M Earle pr qr. And now here at this Day vizt ye 25 Day of June Anno Domi. 1701 ye Said Cause being againe Called and ye Plaintf. having filed noe Decln. The Said Defendt. by Richard Macklin his Attry moves ye Court for a Nonsuite which was granted him Therefore it was Considered by ye Court here vizt. ye 25. Day of June Annoq Domi. 1701 That ye Said Defendt. William Hollinsworth as to ye Said Action goe thereof wth. Day and it is likewise Considered that ye Said Defendt. doe recover from ye Said Plaintf. Danll. Pearce as well ye Sume of fifty pounds of Tobo. for A Nonsuite according to Act of Assembly in that case made & provided as alsoe his Cost & Charges in that case Expended Amounting to ye Sume of one hundred Seaventy & Two pounds of Tobo. & ye Said Danll. Pearce in Mercy Jno Dowdall Clk Comand was Given to ye Sherf. of Kent County ye 13. day of Febry Anno Domi. 1700 that he Take Thomas Cooke & Anne his wife alius Dictus Thomas Cooke & Anne his wife Adrs. of all and Singular ye goods Chatles Debts & Creditts of Robert Devnish late of Said County Decd. to Answer unto James Wrath of A plea of Debt &a. Att which next Court vizt. ye 25 Day of March Annoq Domi. 1701 ye day of ye return[e] of Said writt came Elias King high Sherf. of Said Court & made returne thereof in these words vizt. Cepi Corpus Elias King Sherf. On which Said day ye Said Defendants by Michael Earle theire Attry Appeares and prayes thereof to Imparle untill ye next Court which was Granted unto them ye Same day was given ye Plaintf. likewise Macklin pr qr.
