659) 669 Lord Baltemo.r yet I Conceive that acl cannot take away their Maj.ties Right thereto unlene the Royall assent had been given to such act which doth not appeare to mee was ever obteyned As to the last demand in relation to Bills Bonds Records & other Writeings belonging to his Lo.ps Lands I Conceive that the Bills & Bonds if the Tract be as us affirmed to me by the Lord Baltemo.r that they are his securitys for the severall sumes of Money agreed to be paid his Lo.ps by the Planten upon his granting land to them and that they were in his Custody and seized and taken from his servent thereupon his Lo.p being discharged of the Goverm.t The Case being to I think it may be just and reasonable that they Should be restored to his Lo.ps again and I doe not soe any prejudice can there by happen to the parties by whom such Bonds of Bills ware given the.r they have not executed their Warrants nor had Certificates returned for the Bonds cannot be put in suit till the Lord Baltemore hath parformed the Conditions on his part But I conceive it propar That the Records w.ch are of publique use to preserve the Inhabitans Title to their should be kept und.r the Custody of the Governo.r All w.ch is humbly submitted to yo.r Lordships great Wisdome Tho Trevor Nov.r 2.d 1692 His Maj.ty was pleased to approve of the said Report & did Ord.r As it is hereby Ordered That the Act lately passed in Maryland for the Fourteen pence Tonnage Be & it is hereby set aside a disallowed and that the Lord Baltemore be permitted without any Disturbance or Interruption to collect and receive by which Parson or Parsons as he shall thereunto Authorize and appoint the said Duty of Fourteen pence p Ton for post dutys or Anchorage for his owne use of Right belonging to him by law as Lord Propat.ry of the said Province And As well Cole Copley their Maj.tys present Governo.r as the Lord Baltemo.r and all others whom it may concerne are to take Notice of his Maj.ties Pleasure hereby Signifyed and to Comply with the severall Particulars of the said Report Entred in the Journall of John Nicholas the Councill Booke according to ord.r p me Hen Denton Clk Concil Octob.r 2.d 1693 By his Ex.nice the Governo.r & Councill Ordered that the within Report & Kings Ord.r thereon be Entered as well among the Records of the Prov.ll Office as in the severall of this b and that their Maj.ties Comands touching the said Report to be fully observed to w.ch all persons concerned are to yeild due obeidiance Signed p ord.r H Denton Clk Council This Indenture made the seventh day of October In the yeare of our Lord one Thousand six hundred Ninety and Three Beetween Philip Lynes of S.t Marys Citty in the province of Maryland Merchant and Margaret his wife on the one part and John Cracroft of Calvert County in the said Province Joyner on the other part Wittnesseth That for and in Consideracon of the sume of Three hundred twenty and foure pounds of lawfull Money of England to him the sd Philip Lynes and Margaret his wife or are of them in hand at and before the Ensealeing |
