497) 507 Me Michaell Holmes & Thomas Gray Two of the wittnesses to the within Letter of Attorney & took their Corporal Oathes upon the Holy Evangelists that they did see the within Named Edward Carleton & Dudley Carleton signe seal and Deliver the within Letter of Attorney as their Act & Deed to The Uses therein specified Sworne before me Henry Darnall Which being read and by the Court understood it was by the said Court Considered that the Power in the Letter of Attorney from the aforesaid Edward and Dudley Carleton to the said Thomas was a sufficient Power for the said Thomas Davies to give a full & Legall discharge to any Person whatsoever on the Accompt of the said Edward & Dudley Carleton of London Merchants Thereupon the Defendants by Robert Carvile their Attorny appeares & file his Declaracon And the Originall Invoices which are as followeth Maryland fs Richard Marsham John Hance and Sarah Warring Executors of Bassill Warring late of Calvert County deceased were attached to answere unto Edward Carleton & Dudley Carleton of London Merchants of a Plea of Trespasse upon the Case And whereupon the said Edward & Dudley by Anthony Underwood their Attorny Complaine that whereas the said Bassill Warring in his life time to witt the fifteenth Day of December One Thousand six Hundred Eighty & seaven stood indebted unto the said Edward & Dudley in the sume of four hundred and seaventeen pounds seaven shillings and one penny for a Cargoe of goods Consigned to the said Bassill in his life time by them the said Edward & Dudley as by the Invoyces hereunto annexed may appeare and likewise the one & Twentieth Day of Octob.r One Thousand six hundred Eighty and Eight stood indebted unto the said Edward & Dudley in another distinct sume from the former of five Hundred forty six Pounds Eight shillings and Eleaven pence for another Cargoe of goods Consigned to the said Bassill by the said Edward and Dudley as by the second Invoyce heereunto annexed may Appeare as likewise in the sume of Nine Pounds fifteen shillings for Six Beds sent by the last Cargoe tho not included therein as alsoe in the sum of Thirty six pounds Eleaven shillings and four pence for Three servants sent along with the first Cargoe aforesaid amounting in all ot the sume of One Thousand & Tenn Pounds Two shillings & four pence in Consideracon whereof the said Bassill did assume upon himselfe and to the said Edward & Dudley faithfully promise that hee the said Bassill to them the said Edward & Dudley a just & true account of the said Cargoes beds & servants when thereunto required would well & truely render and the said Edward and Dudley doe in fact say that trusting to the faithfull promise & Assumption of the said Bassill in his lifetime to witt the dayes and yeares aforesaid did Consigne to him the said Bassill the said two Cargoes beds and servants amounting to the said sume of 10 10.ℓ 2.s 4.d which said Cargoes beds & servants by Consignement of the said Edward & Dudley were received by the said Bassill at Patuxant River in Calvert County aforesaid the respective |
