singuler the before menconed or intended to be granted p.rmisses with their & every of their Appurtenances unto the said James Dryden his Heirs & Assignes to the use and behoofe of the said James Dryden his Heires & Assignes for ever And the said Robert Burman for himselfe his Heires Executors & Administrators doth covenant promise grant & agree to & with the said James Dryden his Heires Ex.rs Admi.rs & Assignes and to & with every of them by these presents in manner & forme following That is to say That he the said Robert Burman the aforemenconed two severall pcells or tracts of Land and all & every the p.rmisses unto the said James Dryden his Heires & Assignes for ever against him the said Robert Burman his Heires Ex.rs & Administrat.rs & against all & every other Pson or Psons whatsoever lawfully Claimeing or which shall pretend lawfully to Claime the said Pcells or Tracts of Land & Premisses or any of them or any part or parcell of the same by from for or under him them or any of them or from by for or under their or either of their heires Ex.rs Administrators or Assignes shall & will warrant & for ever defend by these presents And further that he the said Robert Burman now at the time of thensealing & delivery of these presents is Invested & Lawfully seized of the said severall Pcells or Tracts of Land & premisses with their Appurtenances of a good pure cleere & Indefeazable Estate of Inheritance and that the same are free & cleere from all or any Incumbrance or Incumbrances Forfeiture or Forfeitures fine or fines Judgem.ts Execucons Mortgages Intailm.ts Dowers or Titles of Dower Rents or Arrearages of Rent & charges whatsoever except the Rents & services of the Cheif Lord of the Fee of the premisses And that the said two severall Pcells or Tracts of Land and other the premisses & every part and parcell hereby granted shall & may from and after thensealing & delivery of these presents be & remaine without any manner of wast Imbeazellm.t or diminition whatsoever unto the said James Dryden his Heires & Assignes for ever free & cleer and freely & cleerly acquitted exonerated & discharged or otherwise from time to time saved & kept harmless by the said Robert Burman his Heirs Ex.rs & Administrators for ever of and from all Incumbrances whatsoever the Rent due to the Cheife Lord or Lords of the Fee alwaies excepted and foreprized And Lastly that he the said Robert Burman his Heirs Ex.rs & Administrators shall and will from time to time & at all times hereafter upon the reasonable request and at the proper cost & charges in the Law of the said James Dryden his Heirs & Assignes or any of them make doe acknowledge Execute and suffer or cause & procure to be made done acknowledged Executed & suffered all & every such further or other Act or acts thing or things deed or deeds device or devices in the Law whatsoever for the further sure makeing and better confirming of the hereby granted premisses according to the true intent & meaning of these presents as the same by the Councell learned in the Law of the said James Dryden his Heires or Assignes shall be reasonably devised advised or required Provided alwaies and it is soe intended and agreed by & betweene the said Pties to these presents That in case the said Robert Burman his Heires Ex.rs or Adm.rs doe and shall well & truely satisfye & pay or cause to bee satisfyed & paid unto the said James Dryden his Ex.rs Admi.rs or Assignes on or before the nine & twentieth of June now next ensueing the date of these presents the sum of Five hundred pounds of good & lawfull money of England which is the same sum of five hundred pounds menconed in the Condicon of an Obligacon bearing even date herewith entred into by the said Robert Burman to that said James Dryden That then and from henceforth these presents and the Conveyance & Assureance hereby made shall cease determine and be null & voyd Any Covenant Clause article or thing herein conteined to the contrary thereof in any wise Notwithstanding In Wittnesse whereof the said parties to these presente Indentures have Interchangeably sett their hands & seales the day and year first above written |
