NOT INCLUDE ANY PUBLIC OFFICIAL OR ANY FAMILY
MEMBER OF A PUBLIC OFFICIAL. THE MEMBERS SHALL
SERVE AT THE PLEASURE OF THE GOVERNOR, AND ANY
VACANCY CREATED BY THE DEATH, REMOVAL OR RESIG-
NATION OF A MEMBER SHALL BE FILLED BY THE GOV-
ERNOR.

(B)    THE MEMBERS OF THE COMMISSION SHALL SERVE
WITHOUT PAY.

(C)    THE COMMISSION SHALL RECEIVE EVERY FI-
NANCIAL STATEMENT REQUIRED TO BE FILED BY THIS
SUBTITLE. EVERY STATEMENT IS TO BE HELD CONFI-
DENTIAL EXCEPT AS PROVIDED IN SUBSECTION (E).

(D)    EVERY FINANCIAL STATEMENT SHALL BE RE-
VIEWED BY A MAJORITY OF THE COMMISSION TO DETER-
MINE IF ANY CONFLICT OR POTENTIAL CONFLICT OF IN-
TEREST EXISTS BETWEEN THE PRIVATE ACTIVITIES OR IN-
TERESTS LISTED ON THE STATEMENT AND THE OFFICIAL
DUTIES OR ACTIVITIES OF THE PUBLIC OFFICIAL FILING
THE STATEMENT. IF THE COMMISSION FINDS THAT
A CONFLICT OR POTENTIAL CONFLICT OF INTEREST
EXISTS, OR IF THE COMMISSION DECIDES THAT FURTHER
INFORMATION OR CLARIFICATION IS NECESSARY, THE
COMMISSION SHALL CALL THE PUBLIC OFFICIAL BEFORE
IT FOR A HEARING.

(E)    IF, AFTER A HEARING AND WHATEVER FURTHER
INVESTIGATION THE COMMISSION MAY DEEM NECESSARY,
THE COMMISSION DECIDES THAT A CONFLICT OF INTEREST
EXISTS OR MAY EXIST, THE PUBLIC OFFICIAL INVOLVED
SHALL BE INFORMED BY THE COMMISSION. IF THE OFFI-
CIAL IS THEN UNABLE TO CORRECT OR CLARIFY THE CON-
FLICT OR TO EXPLAIN FULLY HIS ACTIVITIES TO THE SAT-
ISFACTION OF THE COMMISSION, THE COMMISSION SHALL
FORWARD TO THE SECRETARY OF STATE THAT PORTION
OF THE FINANCIAL STATEMENT WHICH INDICATES THE
CONFLICT OF INTEREST.

(F)    ANY PORTION OF A FINANCIAL STATEMENT QUES-
TIONED BY THE COMMISSION AND FORWARDED TO THE
SECRETARY OF STATE SHALL BE MAINTAINED BY THE
SECRETARY OF STATE AND SHALL BE MADE AVAILABLE
BY HIM, DURING NORMAL OFFICE HOURS, FOR EXAMINA-
TION AND COPYING BY THE PUBLIC, SUBJECT, HOWEVER,
TO SUCH REASONABLE FEES AND ADMINISTRATIVE PRO-
CEDURES AS THE SECRETARY OF STATE MAY ESTABLISH
FROM TIME TO TIME. ALL SUCH PORTIONS OF THESE FINAN-
CIAL STATEMENTS IN QUESTION SHALL BE RETAINED AS
PUBLIC RECORDS FOR AT LEAST TWO YEARS FROM THE
DATE OF THEIR RECEIPT BY THE SECRETARY OF STATE.
THE SECRETARY OF STATE SHALL REQUIRE THAT ANY
PERSON EXAMINING OR COPYING SUCH STATEMENTS
SHALL RECORD HIS NAME, HOME ADDRESS, AND THE NAME
OF THE PERSON WHOSE DISCLOSURE STATEMENT WAS
EXAMINED OR COPIED."
