(E) OPERATOR SUCCEEDING ANOTHER AT UNCOMPLETED
OPERATION.—IF CUE OPERATOR SUCCEEDS ANOTHER AT ANY
UNCOMPLETED OPERATION, EITHER BY SALE, ASSIGNMENT,
LEASE, OR OTHERWISE, THE DIRECTOR OF THE BUREAU MAY
RELEASE THE FIRST OPERATOR FROM ALL LIABILITY UNDER
THIS SUBTITLE AS TO THAT PARTICULAR OPERATION I? BOTH
OPERATORS HAVE REGISTERED AND OTHERWISE COMPLIED WITH
THE REQUIREMENTS OF THIS SUBTITLE, AND THE SUCCESSOR
OPERATOR ASSUMES AS PART OF THIS OBLIGATION ALL
LIABILITY FOP BACKFILLING, GRADING, PLANTING, AND
RECLAMATION ON THE LAND AFFECTED BY THE FORMER
OPERATOR.

7-515. APPLICATION OF PRIOR LAW.

EACH PIT MINED PRIOR TO JUNE 1, 1967, UNDER A
THEN VALID PERMIT, AND FOR WHICH A LEGALLY SUFFICIENT
BACKFILLING BOND WAS THEN POSTED, SHALL BE BACKFILLED
IN ACCORDANCE WITH THE REQUIREMENTS OF THE LAW IN
EFFECT ON MAY 31, 1967. EACH PIT MINED BETWEEN JUNE
1, 1967, AND JULY 1, 1969, UNDER A THEN VALID PERMIT
AND FOR WHICH A LEGALLY SUFFICIENT BACKFILLING BOND
HAD THEN BEEN POSTED, SHALL BE BACKFILLED IN
ACCORDANCE WITH THE REQUIREMENTS OF THE LAW IN EFFECT
ON JUNE 30, 1969.

7-516. PENALTIES UNDER SUBTITLE.

(A) PENALTY FOR OPEN-PIT MINING WITHOUT

LICENSE.--ANY PERSON WHO MINES COAL BY THE OPEN-PIT

MINING METHOD AS AN OPERATOR WITHOUT HAVING APPLIED
FOR AND RECEIVED A LICENSE AS PROVIDED IN THIS
SUBTITLE IS GUILTY OF A MISDEMEANOR. ON CONVICTION,
HE IS SUBJECT TO A FINE OF NOT LESS THAN $5,000 AND
NOT EXCEEDING $10,000, OR IMPRISONMENT NOT EXCEEDING
