REVISOR'S NOTE: These subsections presently
appear as article 66C, section 659 of the
Code. For purposes of clarity and emphasis
the language has been placed into two
separate subsections. Nomenclatural changes
are made pursuant to Chapter 348, Acts of
1972. The reference to the Department of
Water Resources and the Water Resources
Commission is proposed for deletion because
Chapter 348, Acts of 1972 abolished these
units. The penalty language of this
present section has been transferred to
section 7-516(c). The only other changes
made are in style.

7-504. OPEN-PIT MINING OPERATOR'S LICENSE.

(A) REQUIREMENT; ISSUANCE OF LICENSE.--___A PERSON

MAY NOT MINE COAL BY THE OPEN-PIT MINING METHOD AS AN
OPERATOR WITHIN THE STATE WITHOUT FIRST OBTAINING A
LICENSE FROM THE BUREAU. EACH APPLICATION FOR A
LICENSE AS AN OPEN-PIT MINING OPERATOR SHALL BE MADE
IN WRITING TO THE BUREAU, ON A FORM THE BUREAU
FURNISHES AND ACCOMPANIED BY A $100 FEE. THE
APPLICATION SHALL CONTAIN INFORMATION CONCERNING THE
APPLICANT AS REQUIRED BY THE BUREAU. IN THE CASE OF
AN APPLICATION SUBMITTED BY A CORPORATION,
PARTNERSHIP, OR ASSOCIATION, THE APPLICATION SHALL
CONTAIN INFORMATION CONCERNING OFFICERS, DIRECTORS,
AND PRINCIPAL OWNERS, AS THE BUREAU REQUIRES. EVERY
PERSON LICENSED AS AN OPEN-PIT MINING OPERATOR SHALL
RENEW HIS LICENSE ANNUALLY, AND PAY A $10 RENEWAL FEE.
THE APPLICATION FOR RENEWAL OF A LICENSE AS AN
OPEN-PIT MINING OPERATOR SHALL BE MADE ON OR BEFORE
JANUARY 1 OF THE NEXT SUCCEEDING YEAR.

(E) INVESTIGATION TO BE MADE.—THE DIRECTOR OF
THE BUREAU SHALL INVESTIGATE EVERY APPLICATION FOR A
LICENSE OR RENEWAL. HE MAY NOT ISSUE ANY NEW OPEN-PIT
MINING OPERATOR'S LICENSE OR RENEW ANY EXISTING
LICENSE TO ANY PERSON OR OPERATOR IF HE FINDS THE
APPLICANT FOR LICENSURE OR RENEWAL HAS FAILED TO
CORRECT A VIOLATION OF THE RULES AND REGULATIONS
ESTABLISHED UNDER THIS SUBTITLE, OR TO COMPLY WITH ANY
OF THE PROVISIONS OF THIS SUBTITLE. IF THE APPLICANT
IS A CORPORATION, PARTNERSHIP, OR ASSOCIATION, THE
