EXAMINATION AND REPORT.

7-443. MATERIALS AND SUPPLIES.

(A) IN GENERAL.--___THE MINE OPERATOR SHALL PROVIDE

AND DELIVER AT THE WORKING FACE OR AS NEAR TO IT AS
CAN BE CONVEYED IN A MINE CAR, A SUFFICIENT SUPPLY OF
PROPS, CAP PIECES, AND TIMBERS, CUT SQUARE AT ONE END,
AND AS NEARLY AS PRACTICABLE TO THE PROPER SIZE AND
LENGTH FOR THE PURPOSE INTENDED. EACH WORKER WHO
NEEDS TIMBER SHALL NOTIFY THE OPERATOR AT LEAST ONE
DAY IN ADVANCE AND INFORM HIM OF THE NUMBER, SIZE, AND
LENGTH OF PROPS, CAP PIECES, AND OTHER TIMBER
REQUIRED. IN AN EMERGENCY, THE MATERIAL MAY BE
ORDERED IN THE MANNER THE OPERATOR MAY PROVIDE. IF
THE NECESSARY MATERIAL CANNOT BE SUPPLIED WHEN
REQUIRED, THE MINE FOREMAN SHALL INSTRUCT THE WORKMAN
TO VACATE THE PLACE UNTIL THE MATERIAL HAS BEEN
SUPPLIED. HOWEVER, BEFORE ANY MINER STARTS WORKING
IN ANY MINE WHERE WORK HAS NOT RECENTLY BEEN CARRIED
ON THE OPERATOR FIRST SHALL TIMBER PROPERLY THE ENTRY,
ROOM, OR OTHER EXCAVATION, LAY UP TRACK, AND PREPARE
THE AREA FOR THE WORK.

(E) PRESERVATION OF HEALTH AND SAFETY.—THE
OPERATOR SHALL KEEP ON HAND AT ALL TIMES A SUFFICIENT
QUANTITY OF MATERIALS, SUPPLIES, AND FACILITIES
REQUIRED BY THE PROVISIONS OF THIS SUBTITLE OR RULES
AND REGULATIONS PURSUANT TO IT IN ORDER TO PRESERVE
THE HEALTH AND SAFETY OF EACH WORKER. WHENEVER HE
CANNOT PROCURE ANY OF THE MATERIALS, SUPPLIES, OR
FACILITIES WHEN NEEDED, HE SHALL NOTIFY THE MINE
FOREMAN TO WITHDRAW THE WORKERS FROM THE MINE OR ANY
AFFECTED PORTION UNTIL THE MATERIALS, SUPPLIES, OR
FACILITIES ARE RECEIVED.
