(K) INVESTIGATION OF VIOLATIONS BY EXAMINING
AUTHORITY. - IF THE MINE FOREMAN OR ASSISTANT MINE
FOREMAN VIOLATES ANY PROVISION OF THIS SUBTITLE, OR BY
NEGLECT OR FOP ANY OTHER CAUSE BECOMES INCAPABLE OF
PROPERLY DISCHARGING HIS DUTIES, THE DISTRICT MINE
INSPECTOR, AFTER INVESTIGATION, SHALL PREFER CHARGES
BEFORE THE EXAMINING AUTHORITY AND TAKE ANY ADDITIONAL
STEPS THE NATURE OF THE SITUATION REQUIRES.

(L) RECEIVING CONSIDERATION FOR PROCURING
EMPLOYMENT OR PROMOTION PROHIBITED.—A MINE OFFICIAL,
WORKER, OR OTHER PERSON MAY NOT SOLICIT OR RECEIVE ANY
MONEY OR OTHER CONSIDERATION FROM ANY PERSON TO
PROCURE OR CONTINUE EMPLOYMENT FOR ANY PERSON, OR
PROCURE ANY FAVOR, PROMOTION, ADVANTAGE, OR FACILITY
IN EMPLOYMENT IN OR ABOUT THE MINE.

REVISOR'S NOTE: These subsections presently
appear as Article 66C, section 537 of the
Code. For purposes of clarity, the
subsections have been redrafted as
subsections (k) and (l). The penalty
provision of subsection (1) is proposed for
deletion in light of the uniform penalty
provision in the title. The only other
changes made are in style.

7-404. FIRE-BOSSES.

(A) EMPLOYMENT.—THE OPERATOR OF EVERY GASSY
MINE SHALL EMPLOY A SUFFICIENT NUMBER OF FIRE-BOSSES.
EACH FIRE-BOSS SHALL SATISFY THE OPERATOR OF HIS
COMPETENCE, AND SHALL HAVE FIRST OBTAINED A
CERTIFICATE OF COMPETENCE FROM THE EXAMINING AUTHORITY
AS PRESCRIBED IN THIS TITLE.

REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 605 of the Code.
The only changes made are in style.

(E) WHEN MINE FOREMAN MAY ACT AS FIRE-BOSS.--ANY

MINE FOREMAN HOLDING A FIRST-CLASS CERTIFICATE OF
COMPETENCY MAY ACT AS FIRE-BOSS. IN AN EMERGENCY, ANY
FIRE-BOSS, PROPERLY CERTIFIED, MAY ACT AS ASSISTANT
MINE FOREMAN UNTIL A REGULARLY QUALIFIED PERSON IS
EMPLOYED.
