CONDITION.

(A)    DUTY TO MAKE PERIODIC INSPECTION AND

INVESTIGATION.--EVERY DISTRICT MINE INSPECTOR AT LEAST

ONCE EVERY TWO MONTHS EACH YEAR SHALL ENTER AND
THOROUGHLY INSPECT EVERY WORKING PLACE AND OTHER
EXCAVATION, MACHINE, FACILITY, PROCESS AND THE OUTSIDE
WORKS, SAYS, AND PLANTS OF EVERY COAL MINE IN HIS
INSPECTION DISTRICT OR TO WHICH HE MAY BE ASSIGNED.
HE SHALL SEE THAT THE MINE LAWS AND RULES AND
REGULATIONS ARE STRICTLY OBSERVED AND CARRIED OUT. HE
SHALL MAKE ADDITIONAL VISITS TO THE MINES TO
INVESTIGATE ANY ACCIDENT. THE INSPECTION OR
INVESTIGATION MAY BE MADE AT ANY HOUR, HOWEVER, IT MAY
NOT IMPEDE UNNECESSARILY THE PROPER WORKING OF THE
MINE.

(B)     PERIODIC REPORT OF DISTRICT MINE

INSPECTOR.--THE INSPECTOR SHALL PREPARE A REPORT IN

TRIPLICATE IMMEDIATELY AFTER EACH MINE VISIT. THE
OPERATOR SHALL POST THE FIRST COPY OF THE REPORT UNDER
GLASS FOR 30 DAYS AT OR NEAR THE PRINCIPAL MOUTH OF
THE MINE, CONVENIENT FOR OBSERVATION BY ANY EMPLOYEE,
AND THEN PRESERVE IT FOR ONE YEAR. THE SECOND COPY
SHALL BE FURNISHED TO THE DIRECTOR OF THE BUREAU. THE
INSPECTOR SHALL RETAIN THE THIRD COPY. THE REPORT
SHALL STATE IN DETAIL THE CONDITIONS FOUND IN EVERY
PART OF THE MINE AND MAY INCLUDE SUGGESTIONS AND
RECOMMENDATIONS FOR THE IMPROVEMENT OF CONDITIONS AND
BETTER LAW OBSERVANCE. IN PARTICULAR, IT SHALL BRING
TO THE ATTENTION OF THE OPERATOR OR ANY OTHER PERSON
CONCERNED, AND IS NOTICE TO HIM OF ANY VIOLATION OF
LAW OR RULE OR REGULATION OBSERVED, AT, IN, OR ABOUT
THE MINE. THE REPORT SHALL STATE THE NUMBER OF
PERSONS EMPLOYED IN OR ABOUT THE MINE AND WHETHER OR
NOT THE OPERATOR HAS COMPLIED WITH THE LAW PROVIDING
WORKMEN'S COMPENSATION INSURANCE FOR HIS EMPLOYEES.
IF THE OPERATOR IS SELF-INSURED, THE REPORT SHALL
CONTAIN THE NUMBER OF HIS CERTIFICATE, AND IF HE IS
INSURED BY AN INSURANCE COMPANY, THE NAME OF THE
INSURANCE COMPANY. IF THE INSPECTOR DETERMINES THAT
THE LAW RELATING TO WORKMEN'S COMPENSATION INSURANCE
HAS NOT BEEN COMPLIED WITH, HE SHALL NOTIFY
IMMEDIATELY THE DIRECTOR OF THE BUREAU, WHO SHALL
FORWARD IMMEDIATELY THIS INFORMATION TO THE CHAIRMAN
OF THE WORKMEN'S COMPENSATION COMMISSION, THE
COMMISSIONER OF LABOR AND INDUSTRY, THE ATTORNEY
GENERAL, AND THE STATE'S ATTORNEY OF THE COUNTY IN
WHICH THE MINE IS LOCATED. A REPORT OF THE VISITS,
SUMMARIZED AS TO CONDITIONS FOUND AND RECOMMENDATIONS
MADE, SHALL BE MADE MONTHLY TO THE BUREAU BY EACH
