888                                             LAWS OF MARYLAND                                 [Ch. 4

BECOMES INCAPACITATED, IS SUSPENDED FOR CAUSE, OR
RECEIVES A LEAVE OF ABSENCE, THE DIRECTOR OF THE
BUREAU, SUBJECT TO THE RULES OF THE STATE DEPARTMENT
OF PERSONNEL, TEMPORARILY MAY EMPLOY A COMPETENT
PERSON TO FILL THE OFFICE UNTIL THE INSPECTOR RETURNS
TO DUTY. HOWEVER, TEMPORARY EMPLOYMENT MAY NOT EXCEED
90 DAYS. ANY TEMPORARY EMPLOYEE SHALL BE PAID AT THE
RATE OF COMPENSATION ALLOWED FOR THE INSPECTOR.

REVISOR'S NOTE: This subsection presently appears
as Article 66c, section 502 of the Code.
The reference to the "Commissioner of
Personnel" is proposed for deletion and
"Department of Personnel" is substituted
therefor in light of Chapter 98, Acts of
1970. The only other changes made are in
style.

SUBTITLE 3. EXAMINATION, LICENSING, INSPECTION, AND
SUPERVISION OF MINING ACTIVITY.

7-301. DEFINITIONS - IN GENERAL.

(A)   IN THIS SUBTITLE, THE FOLLOWING WORDS HAVE
THE MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language
used as the standard introductory sentence
to a definition section.

(B)     "EXAMINING AUTHORITY" MEANS EITHER THE
DIRECTOR OF THE BUREAU OR HIS DESIGNEE WHEN REFERRING
TO THE PROCEDURE FOR GRANT OR SUSPENSION OF A PERMIT
OF COMPETENCE OR THE EXAMINING BOARD, PROVIDED FOR IN
§7-206, WHEN REFERRING TO THE PROCEDURE FOR GRANT OR
SUSPENSION OF FIRST-CLASS MINE FOREMAN CERTIFICATE OF
COMPETENCE OR FIRE-BOSS CERTIFICATE OF COMPETENCE.

REVISOR's NOTE: This section is new language
added to avoid the repetitive use of the
phrases "examining board" and "director of
the bureau" throughout this subtitle.

7-302. EXAMINING AUTHORITY TO TEST APPLICANTS FOR
DIFFERENT TYPES OF CERTIFICATES OF COMPETENCE.

SUBJECT TO THE PROVISIONS OF §7-206 AND THIS
SUBTITLE, THE EXAMINING AUTHORITY SHALL INQUIRE INTO
THE BACKGROUND AND QUALIFICATIONS OF EACH APPLICANT
FOR ANY CERTIFICATE OR PERMIT OF COMPETENCE. IT SHALL
