GATHLAND STATE PARK, IN FREDERICK AND WASHINGTON
COUNTIES, SHALL BE DEVELOPED BY THE STATE FOR PURPOSES
OF PUBLIC EDUCATION AND RECREATION, AS FUNDS ARE
AVAILABLE.
REVISOR'S NOTE: This section presently appears as
Article 66C, sections 410 (a), (b) , and
(c) . Subsections (a) and (b) are proposed
for deletion as obsolete because the park
has already been purchased for the price
indicated in the present law, according to
the Land and Property Division of the
Department of Natural Resources. The only
other changes made are in style.
5-1003. STATE PARK BETWEEN BROOKLYN MUD FLATS AND
LIBERTY RESERVOIR ON PATAPSCO RIVER.
THE LANDS BETWEEN THE MUD FLATS AT BROOKLYN AND
THE LIBERTY RESERVOIR ON EITHER SIDE OF THE PATAPSCO
RIVER, IN ANNE ARUNDEL, CARROLL, HOWARD, AND BALTIMORE
COUNTIES, WITHIN A DISTANCE OF ONE MILE ON EITHER SIDE
FROM THE MEDIAL LINE OF THE RIVER, OR EITHER OF ITS
BRANCHES, HAVING BEEN PURCHASED BY THE STATE, SHALL BE
HELD BY THE STATE AS A STATE PARK UNDER THE PROTECTION
AND ADMINISTRATION OF THE DEPARTMENT WHICH SHALL
EXERCISE THE SAKE POWER OF MAKING PULES AND
REGULATIONS AND MANAGING THE LAND AS ANY OTHER STATE
PARK. THE TERRITORY ACQUIRED IS SUBJECT TO ALL THE
GENERAL LAWS PASSED BY THE LEGISLATURE NOT
INCONSISTENT WITH THIS SECTION.
REVISOR'S NOTE: This section presently appears as
Article 66C, section 370 of the Code. This
section is redrafted since the land in
question has been purchased by the State,
according to the Assistant Attorney General
assigned to the Department of Forests and
Parks. The last clause is proposed for
deletion as obsolete. By repealing it, the
provisions of the Act of 1912, Chapter 749
are not being revived. Article III,
section 29 of the Maryland Constitution
prohibits revival of a statute only by
reference to its title or section. The
only other changes made are in style.
