5-904. ANNUAL LIST OF STATE ACQUISITION PROJECTS;
ADVANCE OPTION AND PURCHASE FUND.
(A) PREPARATION OF ANNUAL LIST BY DEPARTMENT AND
ST. MARY'S CITY COMMISSION; SUBMISSION TO
LEGISLATURE.—EACH YEAR THE DEPARTMENT AND THE ST.
MARY'S CITY COMMISSION SHALL PREPARE A LIST OF STATE
ACQUISITION PROJECTS FOP THE NEXT FISCAL YEAR. THE
LIST SHALL BE SUBMITTED TO THE GENERAL ASSEMBLY IN A
MANNER SIMILAR TO OTHER CAPITAL PROJECTS AS PROVIDED
IN ARTICLE 88C, §§ 2(F), 6, AND 10 OF THE CODE.

Code, as amended by Chapter 86, Acts of
1972, wherein it appeared as section 357F,
and Chapter 626, Acts of 1972. The only
changes made are in style.
(B) ADVANCE OPTION AND PURCHASE FUND CREATED AND
CONTINUED; PURPOSES.—AN ADVANCE OPTION AND PURCHASE
FUND IS CREATED AND CONTINUED. THE GENERAL ASSEMBLY
MAY DESIGNATE A PORTION OF FUNDS AVAILABLE FOR STATE
PROJECTS FOR USE TO OBTAIN AN OPTION ON ANY CRITICAL
PARCEL OF LAND IN ADVANCE OF PURCHASE, OR PURCHASE A
SPECIFIC TRACT OF LAND. WHEN THE APPROPRIATION IS
MADE, THE DEPARTMENT AND THE ST. MARY'S CITY
COMMISSION, WITH APPROVAL OF THE BOARD OF PUBLIC
WORKS, MAY OBTAIN OPTIONS TO PURCHASE CERTAIN LANDS.
THE STATE MAY PURCHASE PROPERTY OPTIONED OR ANY OTHER
PARCEL PROVIDED FUNDS ARE AVAILABLE IN THE ADVANCE
OPTION AND PURCHASE FUND.
