5-709. DUTY TO MAINTAIN SAFETY STRIP.
EVERY LANDOWNER, SHALL CLEAR THE SAFETY STRIPS IN
ACCORDANCE WITH THE TERMS OF PART II OF THIS SUBTITLE.

amended by Chapter 801, H.B. 778, Acts of
1973. The provisions dealing with penalty
for violating the section is unnecessary
and covered by section 5-714. The only
other changes made are in style.
5-710. DUTIES OF PERSONS OWNING PROPERTY ABUTTING
RAILROAD TRACKS.
ANY PERSON OWNING PROPERTY WITHIN 100 FEET OF THE
TRACKS OF ANY RAILROAD OPERATING WITHIN THE STATE WHEN
THE DISTANCE IS MEASURED HORIZONTALLY FROM THE OUTER
RAIL, WHO CUTS OR PERMITS CUTTING TREES OR OTHER CROPS
ON ITS PROPERTY SHALL DISPOSE OF EVERY TREE TOP,
BRUSH, AND OTHER INFLAMMABLE MATERIAL CAUSED BY THE
CUTTING SO THAT THE INFLAMMABLE MATERIAL DOES NOT
REMAIN WITHIN 100 FEET OF THE TRACKS FOR MORE THAN 30
DAYS AFTER CUTTING .
REVISOR'S NOTE: This section presently appears as
Article 66C, section 381 of the Code. The
provisions dealing with the gravity of the
offense and penalty for violating the
section is proposed for deletion as
unnecessary in light of section 5-714. The
first sentence is revised to cover all
railroads which operate in the State to
conform with the scope of section 5—707.
The word "person" is defined in subtitle 1
to include firm or corporation. The only
other changes made are in style.
5-711. ENGINE OR BOILER TO BE PROVIDED WITH
APPLIANCES TO PREVENT FIRE.
