RECREATIONAL AREAS, AND ANY OTHER LANDS UNDER ITS
CONTROL. THE RULES AND REGULATIONS SHALL BE POSTED IN
CONSPICUOUS PLACES UPON THE LANDS AND ENFORCED BY THE
FOREST AND PARK OFFICERS.

REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 375 of the Code.
The new language inserted is taken from
Article 66C, section 345 of the Code. The
last sentence is proposed for deletion in
light of the uniform penalty provision in
subtitle 13. The only other changes made
are in style.

(B) OFF-ROAD AND OTHER VEHICLES.—THE SECRETARY
SHALL PROMULGATE PULES AND REGULATIONS REGARDING THE
OPERATION OF OFF-ROAD VEHICLES, AS DEFINED IN
§10-410(D) OF THIS ARTICLE, ON PROPERTY OWNED OR
CONTROLLED BY THE DEPARTMENT. BY JANUARY 1, 1975, HE
SHALL DESIGNATE AND IDENTIFY ADEQUATE AREAS FOR USE BY
THE GENERAL PUBLIC FOR OPERATION OF MOTORCYCLES AND
SNOWMOBILES ON THAT PROPERTY. HOWEVER, NO OFF-ROAD
VEHICLE MAY BE PERMITTED WHERE ITS OPERATION WILL
DAMAGE THE WILDLAND CHARACTER OF THE PROPERTY OR WHERE
THE NOISE FROM ITS OPERATION WILL BE AUDIBLE AT OR
INTERFERE WITH THE USE OF A PICNIC OR CAMPING AREA
OPEN TO PUBLIC USE.

REVISOR'S NOTE: The substance of this subsection
presently appears as Article 66C, section
5C of the Code, as amended by H.B. 1454,
Chapter 640, Acts of 1973. The penalty
provision is proposed for deletion in light
of the uniform penalty provision in
Subtitle 13. The only other changes made
are in style.

5-210. PARK, RECREATION, AND NATURAL AREA PLANNING;
PROTECTION OF WATERSHEDS, MANAGEMENT AND REPLACEMENT
OF TREES.

THE SECRETARY, UPON REQUEST, SHALL ASSIST OTHER
STATE UNITS, COUNTIES, TOWNS, CORPORATIONS, AND
INDIVIDUALS IN PREPARING PLANS FOR PARK, RECREATION
AND NATURAL AREA ACQUISITION AND DEVELOPMENT,
ACQUISITION OF MULTIPLE USE AREAS INCLUDING PROTECTION
OF WATERSHEDS, MANAGEMENT, AND REPLACEMENT OF TREES,
WOODLOTS, AND TIMBER TRACTS UNDER AN AGREEMENT THAT A
PARTY OBTAINING THE ASSISTANCE, PAY AT LEAST THE FIELD
