indicate that the Natural Resources Police
Force is specifically charged with
enforcing the provisions of this title and
that any law enforcement officer is
authorized to do so. The adjective
"practicable" is proposed for deletion and
"feasible" is substituted therefor in light
of similar changes made by the legislative
Council Joint Subcommittee in Title 7. The
provision relating to seizures is proposed
for deletion in light of sections 4— 1204
and 4-1205.

Subsection (c) presently appears as Article
66C, section 121(c) of the Code.

Article 66C, section 239 of the Code is
proposed for deletion because its substance
appears in proposed section 4—1203.

The only other changes made are in style.

4-1205. SEIZURE AND DISPOSITION OF FISH UNLAWFULLY
CAUGHT, SOLD, OFFERED FOR SALE, TRANSPORTED, OR
POSSESSED.

A NATURAL RESOURCES POLICE OFFICER OR ANY LAW
ENFORCEMENT OFFICER, UPON ARRESTING ANY PERSON FOR
VIOLATING ANY PROVISION OF THIS TITLE OR ANY RULE OR
REGULATION PROMULGATED PURSUANT TO IT, MAY SEIZE EVERY
FISH UNLAWFULLY CAUGHT, SOLD, OFFERED FOR SALE,
TRANSPORTED, OR POSSESSED. THE DEPARTMENT MAY DISPOSE
OF THE SEIZED FISH IT ITS DISCRETION.

REVISOR'S NOTE: This section is new language
derived from Article 66C, sections 237 and
713(m) of the Code and similar provisions
of Article 66C authorizing law enforcement
officers to seize fish.

This section is separated from the section
of this subtitle concerning seizure and
disposition of equipment and devices to
emphasize the different manner of
disposition. Since fish are perishable
items, present law allows immediate
disposal upon seizure by authorities.
